      I am renting this property and have been having issues since January 2024 with the foundation in the basement cracking and flooding. Since then, we have been experiencing repeat flooding in the basement that is causing a mildew smell that has started to damaged items such as beds that are in my basement. An epoxy seal was done at one point but it did not help. The walls were also taken down but not replaced and they left behind nails and other materials and it is a danger to my children. There&#**;s also a sewage pipe that has been left exposed. I have submitted requests for maintenance that have gone unaddressed, instead of fulfilling the work orders I am being basically forced out of my home as I have been served an eviction notice.

      We have completed each work order in a timely fashion.  The most recent "flooding" issue reported in November 2024 was tenant caused and charged to them. Excessive hair was found in the plumbing and toilet had been removed by tenant due to object dropped in the toilet per his own admission. An inspection was completed on November 8, 2024 when the most recent issue was reported.  Upon inspection the following was noted and discussed with the tenant: excessive hair in the floor of shower next to drain, toilet removed and outside spigot on front of the house with hose attached was leaking.  The tenant, **** *****, was informed the leaking outside spigot was possibly the source of the reappearance of leaking in walls of basement area.  Upon our subcontractor completing their own inspection and repairs it was confirmed of items and excessive hair found in the plumbing and toilet, no signs of additional leaking in basement walls.  We didn't smell any concerns of mildew in the basement area during our inspection on November 8, 2024. 

      We have filed eviction due to failure to pay November rent balance, December and January rent full amount plus late fees and charges for service call in November 2024.

      The tenants moved the beds and dependents into the basement several months ago.  They have bedrooms on the main level to use for their dependents. We are confused of why they would move them into an environment they are claiming as a health issue. We have offered several opportunities for our professional carpet cleaner to schedule appointment, but were only declined the service and stated they would use their own carpet cleaner and clean the carpets themselves.

      Landlord sent maintenance in October to check and fix the furnace. At the time it wasn't running and we had no heat with children and Animals in the home. After the furnace was fixed months passed and just two days ago the landlord sent a bill naming myself and my roommate responsible for the fee of fixing the furnace it also charged a late fee of 5 dollars a day taking a 380 dollar fee to 1510 dollars. She never told us or got our agreement to this fee. I do not fell we are responsible for this. She should be assuring our home is livable.

      On 11/28/2023 we received work order for water and furnace not working.  Our HVAC team scheduled appointment for 11/28/2023 to assess issues.  The water was not working due to tenants being delinquent on payment to City Utilities.  The furnace high limit switch tripped due to filter being extremely dirty and coils were pulled out to complete cleaning of unit.  It was then determined, the furnace would need to be replaced to resolve damage to unit.  The charges were posted on tenants portal for $380.00 with this description "11/30/2023: cleaned furnace & filter due to excessive dirt to assess issues; water was disconnected due to non payment to city utilities".  The furnace was replaced on 11/30/2023 and the charges did not include replacement expenses.  I spoke to Katherine Crossman on 01/17/2024 on the phone to further explain the charges.  Katherine then informed me she would discuss issue with other tenant and thanked me for explaining the charges on phone.  The $5.00 late fee charge was balance from paying January 2024 rent late and full amount was not received.
