    I purchased a new home from Third Day Builders last spring. Shortly thereafter I discovered a discrepancy with the lot boundaries. The builder misrepresented the lot lines. The builder installed irrigation and sod on my neighbor's lot. I could pay to have the irrigation moved but instead am buying the strip of land from my neighbor. I am asking for compensation in the amount of $1200 to cover the re-survey of the lot. The builder refuses to assist with their mistake. The total cost for buying the piece of land is approximately $7000.00. I'm simply asking for assistance with the survey costs. The lot line deviation is in excess of 50 feet ( nearly 55" ) at the back of the lot. The builder did not do his due diligence to assure he was building within the property lines. The builder physically showed me INCORRECT lot marker locations, and now denies this. I honestly don't know if this was an innocent mistake, or if the builder knew there was an error and they tried to cover it up, hoping I wouldn't notice. Either way, and error was made, and I would like help correcting it.

    ******* ******** purchased a new home from Third Day Built.  BEFORE purchasing, we let him know that our landscaper, Scapes Landscaping, had sodded and irrigated  to his neighbor's fence, which was past Mr. ********'s property line.  Before closing, we told him that Scapes had already agreed to move the sprinkler system into the correct area without charge.  Instead of this option, Mr. ******** decided on his own to purchase land from his neighbor.  We never agreed to help with any of this expense.  Our offer still stands today:  We will gladly move the irrigation at no expense to Mr. ********.  He chose to survey and buy his neighbor's property. This was his choice.  Before closing, we sent his real estate agent, **** *******, the plat map of the subdivision, including the lot in reference.  Mr. ******** signed the measurement disclaimer and the physical description of the property, which is all recorded at the Christian County Recorder's office.  Mr. ******** is saying that we misrepresented the property lines.  This just isn't true.  We pointed out to him that his yard had been sodded too far over.  Mr. ******** also claims that we didn't build in the property lines.  This is also not true.  The city of Ozark requires surveys to be complete before issuing building permits.  All of these surveys are recorded.  Not only are surveys required prior to building, the city also inspects the property multiple times to ensure it is being built in the proper location.  We are still happy to resolve this issue by moving the irrigation, which is our only responsibility in this matter.
