    We hired Mid America Tree Experts to remove multiple trees from our property. The agreed upon job included: Tree removal, stump grinding, and removal of all related brush from the property. We paid with two transactions, and the receipts are attached. The first was the process of felling the trees, and the second was for brush removal. However, the second job was never finished, and we paid $13500 for this.

    Mid America came and felled all of the trees and began the process of removing them. However, the job was left incomplete and we have been waiting for approximately 8 months to have this job finished. None of the stumps has been ground and there are several piles of trees, cutup logs, and brush that remains to be hauled away.

    Each time we contact them, there is some excuse of lack of labor, personal or family illness, etc. While we are patient people, we have waiting 8+ months for a resolution and have other home and yard projects that cannot be advanced until the trees have been removed and stumps have been ground.

    We would like either the job finished as promised and paid for, or a refund of the $13500 so that we can hire another company to perform the job.

    First I’d like to say, I received this 2nd notice today. Never before received the 1st letter. 

    Next I would like to address that many details are not included in this customers complaint. It’s extremely frustrating to see this. I’ve tried to be more than accommodating and giving. When I first met with the customer to give a free proposal, it was made very very clear that this job was a large job multiple removals. 10+ and that it was most fair to both parties that I was going to propose a daily rate. Customer acknowledged and signed. Original quote i estimated. 2 days but not guaranteed. Upon start of the job the customer called me and made the job much much much larger that originally proposed. That was fine because the contract was very clear they were paying for time not quantity of trees and services. As stated in contract as well we would measure the stumps as we flush cut them, to come up with figure on grinding. Even said will come up with a number that’s fair so it wasn’t astronomical! That was before add trees. In total there is nearly 750” of stumps. Which would be $7500 approx just for stump grinding 
    we felled 40+ trees for the customer. The customer only paid for 3 days time. At this time total amount of time on this job is 59 hours which would be 7 days 3 hours. Still every bit of 16 hours remaining on site to finish. I try to be as fair and never have I been the one to come out on top in a situation like this I always take the loss. Which is why I hadnt requested a penny more. 
    And I have not requested a penny more from this customer. Please also take note this customer yard is a steep incline and no vehicle can get with in 300ft, the slightest rain makes it so equipment can’t go down in the yard at all. I’ve paid for a dump truck to haul 15+ loads of debris out of there @ $300 per load. 
    I have also spoke with the customer and. Explained that at this point I’m working on this job out of the kindness of my heart because I’m not some greedy contractor who just doesn’t finish jobs. We take pride in our 5 star rating and go over and beyond for our customers. I explained to the customer that doing this job with it being in the red already for what I’ve paid out on his job and didn’t send those charges his way that it would have to be done in my available time. 

    I do apologize for the difficult times we have had and I’m sorry the multiple family losses we have endured affected our schedule I try really hard to not let our times of mourning ever affect our schedule. 
    With the situation at hand, the last time I spoke with the customer he offered to compensate me to get it done right away and yes I lost a significant family member to me suddenly and i apologize I had to step away from work to collect myself. 
    If the customer would like to compensate a mutually agreed on a discounted price, I’d be happy to move my entire schedule back for him and can start the work on Monday June 5th 2023. Including remove rest of brush and stump grind. I will not give for free anything further for free as it clearly was mistaken for owed to rather than appreciated. I’m happy to finish but if customer wants it to be put in front of paying customers, then he will have to compensate as labor costs, fuel, equipment etc all still require money. I do apologize the customer seems to have forgotten as it was made very clear he was paying for TIME. I’ve never mislead my customers, thousands of customers. Why would I mislead this one? I go so far out of my way for my customers this is so upsetting.
