  On 4/27/24, we signed a contract with *** to have him repair a leak from our rooftop deck. We paid him half ($1730), and he was supposed to do the work while we were out of town for two weeks. Expecting that *** would hit payment milestones while we were gone, we left two checks for him to take at the appropriate time. However, while we were gone, he did NO work and only came to get the checks. He then began calling us about transferring the final payment even though he'd done none of the work. We told him he would have to wait. When we returned, *** said he'd been stalled because the tiles (to replace the decking) were going to take 2 to 4 weeks to arrive (I later found them online...2 to 3 days shipping). He did finish removing the decking and worked on aligning the door (as per the contract). He told us he'd found another source for the tiles that could ship them quicker, but we would have to give him the final payment because it would take a while to get his money back from the first company. We paid him and waited two more weeks. No tiles. At that point, *** suggested that we put some kind of coating on the roof because he'd found so many nail holes. We asked him to price a new roof membrane. He came back with a quote of $3600. We said no. He kept lowering the price until we agreed to $1900 and gave him half. A few days later, I got a VM from *** begging for the final $950 so he could help his daughter get her catalytic converter replaced. We called him and told him we could help him out if he came on Friday and finished some of the things he'd started. *** said he couldn't do that but promised he would get everything finished the next week. We agreed. On Sunday afternoon, *** left a message that he had a medical issue and didn't know when he'd be able to work again. We gave up and called our roofer. We asked *** to deliver the materials we'd paid for and offered to let him work off the money doing odd jobs. He refused & will no longer return calls.

  I am writing to tell the story that ****************** hasn't. First when she signed the contract. She wrote me a check on a money market account. My bank put a 10 day hold on it. They also sent me a letter that it might fake. So they put a hold on my whole account I couldn't pay my phone bill yet alone anything. I called ****************** and told her this. a few days later. So at the time she unexpectedly had a death in her family.

  
  

  So I told her to call me she was up to it. A couple days later I explained to her that I couldn't start the job till her check would clear in 10 days. Finally a day are so she called her money market to get her check to clear.  So she was coming back in the next day or so . She got the creek clear and I did start the work the following day.

  
  

  I tore the remaining part of the deck they were supposed to tear off. I told them not to worry I will get the rest of it off which I did before they got back from their trip. I had a hard time finding the tile because it needed to be a special type that could take the heat. Now she said she found but I really doubt it was the right type. There are so many times that say they're for decking. If you look a little closer it will tell it's not made to be in the sun constantly or it would melt.

  
  

  That's how all this started now first of all I couldn't put the tile down till found the leak and fixed it. So I did almost everything else on the contract. Other than some painting. I had to get certain color to match what I repaired. No I couldn't do much with the tile till everything else was done. She had a tarp that had nails coming up through the tarp. I told her I can't put the tile down till I recover the tarp. I suggested a type of coating but she to didn't like that idea.

  
  

  I said I could replace the tarp with a white one so if would repell some of the heat of the tile. So then they asked to fixed their front porch ceiling because it was falling down. They wanted me to tear it off and put a new ceiling in. I said that was going to be expensive to do. So I told them I might be able to fixed the ceiling without tearing it down and would save you a lot of money. So I fixed the ceiling of her porch right then it took me away from the the roofing work. It took me a few days and I should how I could make her doorway look better. They liked my idea and I fixed that for them no complaints.

  
  

  Now who ever remodeled the house wasn't very good at doing some of the work. The roofing I was had more damage that we didn't know until I removed the hand rail to see why these boards were loose. So I had to replace the top edge of the roof because all the boards were just laying there nothing was fasten down. So that took me a few more days. I even fixed so they wouldn't need to have a drop edge so there was no chance of the water backing that caused the major leak.

  
  

  So I also had to replace siding that was around the whole roof which I did. So then I had to take all the casing off around the door because they had all crooked and the leak was by the patio door and wasn't properly installed. So I spent 4 long hours trying to fixed the door and rehang it so it closed right. I had do some special things like filling the holes for the look and redrilling new one the next day when the special filler dried. 

  
  

  Now the patio door was working properly because I had them check to show them that I fixed the gap where the rain was also coming in. They told me it looked great so that was also completed. After the other work was just about done she kind said well maybe the tile might be temporary. So because the tile was taking awhile I was going to do the tarp. Now she didn't like the first price I gave her with the white tarp which is why it was higher because it repelled the heat. So I told I look and see the black was going to easier to install so I lowered the price. Because it was cheaper and easier to do . I even cut my labor down because of the work they giving me.

  
  

  So now all of a sudden after we made the deal on the roof tarp. Well she told me to take all my tools home . There she breach the contract. Then she had her roofer come and give her a price to put the tarp down I guess it was cheaper. So she breach the contract again. I told her that you can't do that that you're breaching my contract. So she didn't seem to care so then I she called me and said she was going to have her roofers do the tarp after she contacted me to do it. I did order the tarp which I had to cancel because of what she was trying to do . Once again I told her to read my contract. I told her you're breaching my contract you can't do that. She broke the contract when she had someone else starting to do the work and then I was finished.

  
  

  She breach my contract to many times and didn't care so I cancelled everything. I was done at that point. In the next paragraph I am going to write what my contract actually says.

  
  

  This  contract shall only to become binding upon written acceptance by the property owner contractor or an authorized agent of the contractor.

  
  

  Delay in completion cause by the acts of God, strike's, accidents and other causes beyond the contractor s  control ,shall not operate as a forfeiture of thereby ,time not being of the essence of the contract.

  
  

  Second part

  
  

  This is a contract and has a 3 day cancellation period after that, contract becomes binding after. Work done by Frischman Remodeling is to be finished and serviced by Frischman Remodeling or contract is void. If contractor is unable to collect remaining balance when job is completed, customer will be liable for all attorneys fee and expenses to collect money owed. Any extra won't in contact will need to be paid for when work is completed. Material will be paid before work is started. All work is warranty for one year on labor and materials furnished by Frischman Remodeling.

  
  

  So you see she breach and broke the contract. I tried to explain to her you can't just break a contract and hire someone one else your in breach of the contract. 

  
  

  So when I got sick I had a gallstone attack and couldn't stand or do much of anything. They had to do tests to find out what was wrong. Then they determined it was gallstones.

  
  

  I am sorry for the delay in answering but was in a bad car accident and they did some testing 

   They determined I have a concussion and real bad whiplash. I am starting therapy this coming week. I tried to be nice I did things for nothing I also saved her thousands of dollars on her porch. Now if I really wanted to rip her off I could of tore her roof down. I

  
  

   would charge her 3-4 thousand. I fixed for her and charged ******. Now how many contractors would do that. I could made a lot of money just going ahead and tearing the ceiling down. But I am honest and I don't want to do anymore work the I have to. So I save her a lot of money and I don't know how much damage there was underneath the ceiling but it seems fine and fixed to save her money.
  
  I'm sorry but ****************** did the things that caused these problems. Also I couldn't do any work on the roof because that's when the weather started getting into the hundreds. It would been 175 on that roof. I couldn't kneel on it even before it was a hundred I had have kneel pad to kneel on or I would burn myself touching the roof.  So there is more than ****************** said.
