    They didn't honor a signed proposal and held back deliverables. I paid for this. They asked for more money. He is holding back items and won't do the original assignment that was paid.

    I would like the boundary surveys that I paid for.

    Attached is the signed contract for field work for a boundary survey with Mr. *****. As outlined in the contract the following were included as part of the $1600.00 contractual agreement, which payment was received:

    1. We will perform a boundary survey of parcel ID#:********* & *********  - 
    2. We will locate existing property corners.
    3. We will set lathes approximately every 50 feet along the property line at the proposed 5 foot and 10 foot offset lines of new proposed easement.
    4. We will show locator map, north arrow and plan scale.
    5. We will establish horizontal and vertical control with (GPS) VRS Network.
    6. We will show the location and identification of all existing right of way lines, easements, and setback lines of record.
    7. We will provide a signed sealed easement exhibit, if needed.

    Boundary Survey & Easement Survey $1,600
    Easement Exhibits $300(each parcel)

    The signed sealed exhibit (the document in question) would cost an additional $300.00 per parcel if the consumer requested. 

    If the consumer needed a signed document, the additional cost was included in the contract (see number 7). 

    When invoiced for the requested documents ($600.00 total for two parcels), the consumer refused to pay the additional amount for the signed sealed easement exhibit.

    I am rejecting this response because:

    Proposal Item #6 states that all existing right of way lines, easements, and setback lines of record will be shown.  Title informational reports with legal descriptions for both subject properties were purchased and provided to vendor. 

    The initial exhibit provided did not include any easements referenced on the title reports.  After asking about the easements, only one easement referenced was added to a neighboring parcel that was not one of the two subject properties.  I was informed that was the easement detailed at that book and page number.  Item #13 on the title informational report for *** ******* ** includes two sets of book & page numbers for that easement, only one set of book and page numbers is referenced on the exhibit.  Item #11 on the same title informational report for *** ******* ** references the ******** ********* easement at a different book and page number than referenced above, but is not included on the exhibit.  As seen on both exhibit versions, the ******** ********* Pipeline easement is not shown on either subject property.  In addition, as seen on the title informational reports, there is an easement noted as Item #12 for *** ******* ** that is not noted on either exhibit versions.      

    When speaking recently with vendor about purchasing at least one $300 easement exhibit, the request for boundary surveys with Proposal Item #6 completed was made the second time.  I was informed that would require additional fees for the research work on the easements.  I was also informed that the boundary survey work noted on the proposal for $1,600 was only for the field work, not certified copies of a boundary survey.

    Vendors website states that boundary surveys will meet Minimum Standards for Property Boundary Surveys for the state of Missouri.  The General Land Surveying section of those minimum standards list a plat that bears the signature and seal of the surveyor as a deliverable furnished to client.  The proposal does not state that a boundary survey deliverable is not included in the $1,600 for the Boundary Survey & Easement Survey.
