    Ive been dealing with this development company for over 5 years now and Im still waiting on my house to be completed. The owed of this company takes no accountability for the lack of progress being made. I was told this project would only **** * months.. its been 3 years now. I closed on my construction loan back in 2023 absolutely nothing was done until Oct 2024 now they are using the weather as an excuse why nothing is being done although my home was built in a factory. Reasons why they claim building has been delayed had absolutely nothing to do with me. Im paying bills and taxes on a house Im not even able to live in. My children and I have been displaced for over 3 years because of the delays with this company. Ive asked for my money back several times before it got too far and I was assured everything would go as planned.. that was a lie.. I cant get any answers out of the peer because she chooses it ignore my emails and the calls from the bank. I hate I had to do this but Im left with no other options

    We appreciate the opportunity to respond to the complaint submitted by Ms. ***** ****** regarding her home construction project. While we understand her frustration, we must address the false and misleading claims she has made.
    False Statements & Misrepresentations:
    Ms. ****** has blatantly lied and mislead in her complaint.
    We have every email and text message documenting our communications, including updates on the progress of her project.
    We communicate regularly with her, with the bank and the inspectors they send out. These inspectors have confirmed the work completed at each stage.
    Despite her claims, we have offered to return her money multiple times, but she chose to proceed with the project.


    Original Agreement & Responsibilities:
    We first met Ms. ****** in June 2021,not five years ago, not even four years ago.
    She was initially was purchasing a lot with others, and they were responsible for splitting the lot, securing permits, and handling the historic district requirements and spliting the costs, this was the only way she could afford the house.
    And there was also supposed to  sweat equity to the project. Our company was only assisting in the process, not managing it in full.
    When her family member no longer qualified for financing, she was unable to afford the house on her own, but instead, we stepped in to help find a buyer and complete  the permitting processl, we took on additional financial risks to help her move forward.
    Delays Were Not Caused by Our Company:The delays were out ours and her control and we did everything we could to move the process along
    Ms. Calvin  the lot split took months and was not completed until February 2023 and she did not qualify to purchase the lot until July 2023. (City)
    Her original bank changed its loan terms, requiring her to find a new lender, which further delayed the process.( Lender)
    The home is in a historic district, requiring multiple layers of approval. After initial plans were completed, the historic commission changed their requirements, forcing a redesign, additional meetings and approvals that took from February 2023 until March 2024. (City)
    The city then required both homes on the lot to be permitted and constructed simultaneously, which added further complications.(City
    Additionally, there was an issue with the state permit that caused additional delays .(State)
    Construction & Weather Conditions:
    Ms. ****** closed on her construction loan in December 2023.
    Work began in October 2024, after the final permit approval which was 9/17/2024 and additional funding for the second house was available which was a requirement of the city, but weather conditions, including snow, rain, and mud, have made the site unsafe for heavy machinery.
    While she claims this is an excuse, it is a factconstruction cannot safely proceed under such conditions.
    Financial Impact & Additional Support Provided:
    Ms. ****** neglects to mention that the historic districts requirements led to significant additional architectural costs, which she did not contribute to.
    We personally took out a loan to construct the second home required under the historic districts guidelineswithout this, she would not have been able to afford her house.
    Final Statement:
    We are beyond frustrated with the false claims in this complaint. The delays she refers to were not caused by our company. When her family member no longer qualified, we should have walked away. Instead, we went above and beyond to ensure she could still proceed with the build.
    We have been transparent with Ms. ******* the bank, and inspectors throughout this process. The records clearly show that her accusations are false. Again, we have even offered to refund her money multiple times. We are extremely disappointed by the dishonest portrayal of events in this complaint.
