this is regarding an auto accident in 2021. I was not told by my attorney that there was a "cap" on the insurance end, but he told me three times that it was discussed. So after 4 years of expecting going to court, which I told him from the beginning and was never told that wasn't going to happen. I was given a settlement that in no way compensates my medical condition and need for treatment/surgery, lost wages equivocal to less than poverty level, pain and suffering, and now I have to file for disability because I cannot work. Also, I think there may have been commingling of funds as I had two car accidents/cases within 3 weeks of each other and not certain the settlements were calculated correctly.Business Response

Ms.******:
We are sorry that you are disappointed with the result of your case. Personal Injury cases have many moving pieces when it comes to resolution. As you stated you were involved in two motor vehicle collisions within six weeks of one another. We represented you on both and obtained the policy limits of insurance coverage available on both. It appears you are taking issue with the available insurance coverage and believe it was not explained to you.
What you are referring to as a cap on insurance was the policy limits of the insurance available. The second claim was the first to resolve. It was an uninsured motorist claim against the insurance carried by the rental vehicle you were driving. Again, we were able to obtain the policy limits of insurance coverage for this matter. At no time during our representation did you raise any issue with understanding what that meant or ask any questions that could have led to any belief you did not understand the concept of insurance limits.
With regards to the first collision and the second settlement, we were seeking the policy limits of the at fault driver and the insurance company refused to pay it to you, this was explained to you prior to filing suit. In fact, the insurance company originally denied any liability on part of their driver and blamed you for the collision. Through our investigation and obtaining witness statements and pursuing litigation on your behalf were we able to change their liability decision. Secondly, when the defendants did offer to resolve this case, they offered on 20% of what you eventually obtained. During litigation we took on extensive work, deposing witnesses and doctors to testify about the collision and the injuries claimed. Additionally, during your time in my office to give your deposition, was our first discussion of what we were demanding in the case to be paid to you. This was explained that ********** had a certain policy limit and we are not coming off that policy limit. Lastly, when the policy limits were offered to you, we provided to you options. I informed you that we could accept the policy limits offer from the insurance company or proceed with litigation and trial. We explained that in the event a jury was to award you a favorable decision over and above the insurance companys policy limits we would have to pursue additional litigation to recover those funds via a garnishment action against the at fault party personally or against the insurance company if a bad faith case is successful. My office particularly made clear that we would represent you either way you decided.
After the policy limit offer was made by the insurance company I provided that information to you. We spoke at least twice on the phone and I answered all of your questions. Additionally, we communicated via email for follow up questions. I know for certain no rushed decision was made, it appears you had taken about a week to make any decision. After the decision was made, we negotiated with the medical providers to reduce any medical billing that was outstanding to maximize the amount of the settlement you were to take home. Moreover, we charged less than our contractual fee. Goldblatt + Singer reduced our own attorney fee to do what was best for our client. I would also like to point out that although outside of our course and scope of representation, we handled your property damage claim pro *****
We are truly sorry that you were not pleased with the results but we can say for certain that we put your best interest first at every turn of both cases, answered all of your questions and offered our continued counsel and representation at every step of the case, including resolution.Sincerely,
*********** ********

I have multiple complaints with this company, the most recent issue would be not receiving my settlement check that i signed a release for on 05/31/24. When I called to check the status I was transferred to a woman who told me she is waiting to hear from the insurance companies on any further bills, this in my opinion should have been done before I signed the release. It has been an ongoing journey with this company since 2021 and I felt they are still dragging there feet with my case. I would like to receive my settlement check and be completely done with them. I have received horrible service since 2021. I have been told multiple things that seems like all lies.Business Response

Our office settled this matter on 5/21/24 with the defendant. We received the settlement release from the adjuster for the defendant on 5/31/24 and forwarded it to **************** to sign electronically. It was executed by **************** that same day, which was a Friday. On Monday, 6/3, the executed release was forwarded to the adjuster for the defendant so that the settlement check could be sent. Because the checks are mailed and not sent electronically, it can take some time to receive. On 6/6/24, **************** contacted our office regarding the status of the settlement check being received. As our office had not yet received it via mail, the attorney handling ******************** case reached out to the adjuster for the defendant to inquire as to the status. He sent an email to the adjuster as well as left a voicemail. He again followed up with the adjuster on 6/12/24 and 6/21/24 with no response. The settlement check was received by our office today.
In addition to securing the settlement check, our office is also working on finalizing the health insurance liens on ******************** case that have been asserted by her health insurance plan. Because these companies request information related to the settlement (settlement amount, attorney fees asserted, case expenses) in order to consider a possible reduction, we are unable to begin these reduction negotiations with these companies until the case is fully settled and a release is signed. The negotiations for reductions of these liens began on 6/6/24 and are still continuing. We are working to get **************** the fullest reduction we can for these liens that we must pay. As of 6/27/24 we have an agreed reduction, however, the attorney working on the case is asking for an even deeper reduction to benefit **************** and we are waiting to hear back from that company. The adjuster we are negotiating with must get authority to approve the deeper reduction.
The attorney handling the case will be reaching out to **************** today to discuss in more detail and answer any further questions she may have. Our office is working to get her the most value we can out of her settlement and that does take some time.

Client's attorney had a lengthy conversation with him on 5/8/24, largely about his two claims with our office and this complaint. He stated he was not upset at all and just said he hadnt heard from us in a while. He was very nice from start to finish and agreed to take it down or retract the complaint.
In addition, the handling attorney for this client searched his emails and was able to locate one voicemail from this client since the inception of his first case in January of 2023. There were also no messages from the reception team that this client was attempting to get in touch with our office. The paralegal assigned to the case also with him within the last few weeks.Customer Answer

I can't get any results from this company. I have two cases with them I can't get one of them completed. I haven't heard from them since I filed last complaint. Not a good lawyer company. They want me to get another lawyer and they still get paid. I wouldn't recommend this company to anyone.Business Response

Our office spoke to Mr. ****** on the date of this complaint to wrap up his cases. It's unclear on the timing of the complaint being filed (before or after his phone call with his attorney) but he made no indication of his displeasure during the call or since that time. We have settled one is his cases and are working towards settlement of the other. Mr. ****** is aware of what is going on for his files and has been in communication with his attorney several times on the date of his complaint and after.Initial Complaint

This complaint is completely false and defamatory. Your case was settled for a substantial sum over two years ago in 2021. This is the first time that we have heard from you since the date of settlement. I have left you over a dozen messages to understand why you feel entitled to more funds years later. Unfortunately you refuse to take my calls other than yesterday when you hung up on me. We are at a loss as to why you have suddenly made these outrageous complaints after a very successful result. Not one person in my firm told you that there was a check for you waiting at my office. Certainly you and I have never spoken about a check or any other issue for that matter since the date of settlement years earlier. All of the statements in the review above are completely false. ***** and his girlfriend have posted numerous false reviews over the last few weeks on different sites. I have never in my 28 years of practice "skipped out" on paying a client. That is both insulting and completely untrue. You can not post false and defamatory information without ramifications. Because of these outrageous statements, we look forward to addressing these fake allegations and clearing our name in a Court of Law.Initial Complaint

I hired ***** and Tim to represent me in my car accident and injury case . There was a $763.53 on my credit report from ********* *********** agency. This bill was from *** ****** hospital ********* Depart. The lawyers I hired was suppose to take care of this bill. I contacted the Lawyers and they informed me that ******** paid it and they paid ********. The reason why I know about this is because my car was stolen last year and I went to look for another car and I was wondering why my interest rate would have been so high. I seen this bill on my credit report. I would like to be refunded in the amount of $763.53.Business Response
