    I signed a contract with this company to have some potholes filled but explained to them I didn&#**;t want the services yet and would let them know when I wanted the work done. They kept reaching out to schedule a time and I let them know multiple times I did not want the services done yet. They eventually went, without my permission, and filled the holes anyway and are now requesting payment. I told them I will not pay for the services as I told them multiple times I wanted it done down the road and I wasn&#**;t ready. The contract does not have a time frame of when the work had to be done. The work was also done poorly and there was standing water on top of where they filled the holes.

    Response to Customer Complaint:

    We appreciate the opportunity to address the concerns raised in this complaint. This customer signed a contract with us on April 17th, 2024 for asphalt repairs,marking the sixth project we have successfully performed for her. Over the next four months, we made multiple attempts to schedule the agreed-upon work, but each time, the customer requested to delay the service.

    In August 2024,we reached out to the customer again to schedule the repairs.  The customer wouldnt provide us with a date.  In good faith, we offered to cancel the contract if she no longer wished to proceed with the repairs. The customer, however, confirmed her desire to move forward as per the original terms of our agreement. As a result, on August 12, 2024, we completed the contracted work without any disruption to her tenants or the operations within the property.

    Following the completion of the work, the customer refused to pay for the services rendered.Its important to note that, per the terms of the signed contract, the customer agreed to provide us with unimpeded access to perform the necessary repairs.The customers claim that the work was performed without permission is not accurate, as she had multiple opportunities to either cancel or proceed and opted to continue with the contract.

    As for the quality of the work, we stand by our longstanding reputation for excellence,and we regret that the customer feels unsatisfied.  However, we were hired simply to fill in potholes with hot asphalt.  Potholes are generally found in low lying areas of parking lots and roads.  The holes are a result of standing water left over prolonged time eventually degrading the asphalt into a pothole.  We were not hired to remedy water issues with the parking lot.  Our scope of work provided in the executed contract does not provide for fixing water areas.  The customers original request made no mention of water areas.  The scope of work agreed upon is our lowest cost solution that eliminates exposure to liability quickly.  Only repaving the entire lot would remedy the water issues mentioned.  We were not hired to pave the entire lot; only to fill in holes.  We performed the work successfully.

    Unfortunately,rather than resolving the matter through direct communication, the customer posted this complaint after receiving a formal demand for payment. While we prefer to settle matters amicably, we are left with no choice but to pursue legal action for non-payment and disparagement.

    We remain committed to delivering quality service and hope to resolve this matter swiftly and professionally.
