    I hired them to do a chip and seal road for my driveway. The stole over 20 tons of stone that was on the driveway and laid a layer of tar that was too thin to withstand vehicle traffic that immediately began failing immediately and was obviously not done correctly. Now well over 90% of what they did has long failed and I had to have 6-5axles, $320 each;$1920, dump truck loads of lime stone brought in to replace the stone they stole and correct the grade to avoid significant damage to my home bc it was acting like as a waterway dumping directly on my hhouse. These areas of stone only corrected the grade of the road for about a 3rd of the road but it has dramatically outperformed the job they did that never worked at all and in fact made the road worse immediately. I contacted them immediately many times over regarding the failures and was completely ignored until writing reviews online, and then he said he'd come fix it but never did. I have lots of pictures and all of our conversation history to verify all of this.

    I first requested a quote for asphalt/chip and seal services from an advertisement on ********* The company's name is Action Asphalt. They came out the next day and gave me a quote for chip and seal for my driveway and the driveway down to my parent's house. I am not sure the total linear footage, but the price seemed fair to me, and I have really no complaints for the price but the quality of work performed is horrendously poor. They told me they could do the work for that price, but we had to pay that day and the work would be performed that day. The gentlemen I spoke with told me his name was **. I agreed to the work, and we paid him half before and half after. They performed the work that day and finished up the next day. The chip and seal job did not look the best, but I was hopeful that it would hold up which was more important. We parted ways at that time. Within 3 weeks to a month, grass had grown up in the middle of the chip and seal job in large swaths. I have photos and it is awful. We called the owner to complain, and he explained that he doesn't cover vegetation, but that he would spray a chemical that would kill the grass. It took him a few weeks, but he did eventually come out to spray. The spray killed everything that was visible at the time, but grass just came in a filled the spots adjacent to where he sprayed. We called him back numerous times asking for out money back but again he claimed that he did not cover vegetation. We told him it was washed out in places and that it looks terrible. He should cover replacement or refund based on the poor workmanship that just so happens to also cause the vegetation to grow within. He refused and played like he was a good guy, but after making legitimate claims and reviews on his ******** he has now blocked me. Something seemed fishy about the whole thing to us, and my wife wanted her money back or at least a rework.

    On 13 APR 23, Action Asphalt came to my door after servicing a neighbor's driveway. They asked me if I would like to have my driveway done, I explained, that I get a lot of weeds in the summer months on my current gravel driveway and would love that that to no longer be an issue. I asked Will this take care of that? he explained "yes" with some further explanations as to why this prevents this issue. I agree, as I explained I was excited to have a clean driveway, with no issues. This is where everything goes downhill..

    They had equipment issues that caused excess spillage of the tac oil, did not kill the weeds, and laid down an incredibly inconsistent tack coat (extremely thin and thick). I had concerns about sweeping, tar-dense areas, and weeds when he came back for payment, but when he came back he assured me everything was fine, without even looking at the road.

    Not even a month goes by, and the entire road is nearly covered in grass and weeds, I have 4 major areas where it is essentially a tar pit, and now areas where I have driven over it and it has pulled parts of the road up completely, not to mention, dry grass sticks to it like crazy oh, and 10 gallons of Spectar weed and grass killer later it still looks like complete trash.

    I contact the owner consistently, and he assures me he will come out to assess and correct the issue, The day comes, no show no call. I text and call at least twice a week, one out of every 10 calls, I may get an answer assuring me he will be coming out. I empathize as he explains some hardships, however, it is no way an excuse to treat a customer like this, let alone one who you have been dodging for coming on 6 months now.

    I have had an assessment done by another paving company to solidify my thoughts and feelings about the matter, which are completely valid according to them. I plan to take this to the courts, have the work redone by someone else, if he cannot remedy the situation before I file with the local circuit court.

    I am rejecting this response for the following reasons:

    1. Our initial discussion had no mention of “cheaper alternative” a neighbor let him know I would like to have my driveway chip sealed and to summarize the encounter, he knock on my door, and gave me a price for a chipseal driveway, I stated the price sounded fair, let’s do it. 
    .

    2. The originally listed reasons. 

    3. I have made numerous attempts at contacting the owner who has agreed to come back and have someone come back and address my concerns, understanding that I was right in my feelings. The attached text messages will show at a minimum my follow up to phone calls we have had with one another, he agrees to show, and never does.

    4. To ensure I do not have buyers remorse, I have had two separate paving companies inspect and re-quote the cost of chipseal. They both agree, that my driveway at this point may not even be repairable and the work was far below substandard.  Furthermore, I have a memo from faith paving stating that the quality of work does not meet even the minimum standards.

    5. There are numerous people in the Springfield metro area that are also stating the same issues, I am very much not alone on my position.

    Action Asphalt came out here on March 17 2023 to do my driveway.  They left their trailer parked here for 3 weeks.  When they finally came to pick up the trailer they made ruts in my yard.  They also made ruts behind my shed.  I have called constantly for someone to come out and finish my driveway, which is still incomplete, and removed the ruts they made in my yard.   I was told by the owner that he would come out personally and take care of it himself.  That never happened and now they are refusing to answer any of my phone calls.  Last Sunday he told me someone would be here and then the owner told me the same thing and still no one has been here.  I have already paid them for the work which was a mistake. I want the work I paid them to do to be completed immediately.
