    ********************* is the owner of this company. He came and gave me an estimate on my fence and requested 1500 down at the beginning of January. I provided him a check for the full amount which was cashed. He told me he would be out to build the fence in 4 to 6 weeks. I heard from him in the middle of February and he said that he would start the following week. His phone is disconnected, and I have not been able to reach him through any means since that time.

    Subject: CONTRACT CANCELLATION Table Rock Fence LLC and/or *********************,It has become apparent that your performance on the fence replacement project at ***********************, has deteriorated to a level that is no longer acceptable nor tolerable. This poor performance issue has resulted in creating many other problems and expenses,including delays and distress. Despite having already expressed our concerns to you regarding these performance issues, there has not been any meaningful attempt on your part to improve your performance without prompting.The lack of confidence in your professional ability, coupled with inadequate communication and reliability, has significantly impacted the projects progress. As a result, we have lost faith in your ability to deliver the quality and reliability we expected.Therefore, we regret to inform you that we are canceling the contract with immediate effect. We believe it is in our best interest to seek an alternative contractor who can meet our expectations.Contributing Factors, but not limited to:- Lack of prompt and timely communication. (includes email, phone, and messaging)- Failures to effectively and timely submit necessary requests.o Building Permits Only submitted after I stated it wasnt submitted and for perceived rejection.o Dig-Rite 811 Only submitted after I stated that they had not marked property yet.- Repeated statements on when work would begin to not show up nor communicate why and expectations on when you would.As outlined in our signed contract the cancellation of the contract by the Buyer (me) has an agreed cost of 10% of the project total quoted in the contract.- Contract quoted total: $9,436 @ 10% = $943.60 - Paid deposit of $5,660 ; ************ 11/10/2023 - Balance to be refunded to Buyer: $4,716.40 The total of $4,716.40 is due upon receipt of this written notification paid by Table Rock Fence LLC or *********************.
