    I purchased a new TYM Tractor from *** in February 2024. Since purchase, the tractor has experienced repeated air conditioning system failures, rendering it unusable during hot weather. The tractor was in their shop waiting for parts for over two month... In the meantime I had planned on trying to sell the tractor to cut some of my losses because I'm moving out of state... however since it was in their shop over 2 months, I ran out of time finding a potential buyer. Dealer claims they have now fixed the the **** problem, however a new roof will be required which will cause additional delays. All of these issues resulted in significant downtime and lost productivity. I had been making payments on something that I cannot use. Dealer admits that they did not thoroughly check the **** system before they sold it to me because it is not on their pre-sale checklist to check the ** line pressure. This could have all been avoided if they had checked the **** system before they sold it to me because they would have identified the problem before making the sale.Additionally, I have invested over $7,000 in mower and other implements for use with the tractor, which are now unusable due to its defects. The extreme temperatures inside the cab (reaching over 115 degrees) make it unsafe to operate during hot weather, further demonstrating that the tractor is unfit for its intended purpose.I have contacted the Missouri Attorney General and my lender regarding this issue. I am requesting that *** take back the tractor and pay off the remaining loan balance, as I no longer wish to keep this defective product.

    I have attached a summary from our Service Manager on the details of the work order.  I was not aware of the situation until WCT received a letter from the customer stating that the ************************* was contacted, and that customer did not attend on making any more payments on his tractor loan and wanted us to come pick-up loader and implements (that he purchased elsewhere).

    I immediately called the customer to get details of the situation.  A that time, customer said that he was moving out of state and no longer needed the tractor.  He was not interested in WCT helping him sell his tractor, he just insisted that we buy it back.

    I have reviewed the business' response and am rejecting it because:

    I continue to expect WCT Lawn and Farm to buy back the tractor due to their failure to prioritize health and safety, violations of *** standards, and demonstrated incompetence in diagnosing and repairing the air conditioning system.


    In Paragraph 1, *** admits their inspections relied on low ambient temperatures (3639F) and lacked pressure testing with mechanical gauges. This inadequate inspection method failed to identify the factory charge issue or potential leaks, undermining their claim that the tractor was field-ready.


    In Paragraphs 4 and 5, WCT confirms that refrigerant leaked into the cab due to a faulty evaporator coil. Offering the tractor for use during this period directly endangered the operators health and violated EPA Section 608 regulations, which prohibit knowingly operating equipment with a refrigerant leak. Allowing this situation to persist reflects negligence regarding both environmental and safety standards.


    In Paragraph 6, WCT dismisses repeated ** system failures by stating the tractor remained "usable." However, they contradict themselves by documenting at least three instances of ** malfunctions and delays in repairs. This timeline demonstrates an inability to correctly diagnose and resolve the issue, which erodes trust in their technical competence.


    Finally, in Paragraph 8, WCT attempts to downplay the health risks of operating in 115F temperatures, offering hydration and breaks as a solution. This is unacceptable and demonstrates a lack of concern for the operator's well-being, especially when the ** systemcritical for operator safetywas not functioning.


    Given WCT's mishandling of repairs, repeated system failures, and disregard for health and safety, I no longer trust their ability to fix this tractor properly. A buyback is the only acceptable resolution to address the risks posed by their negligence and incompetence.
