This addresses the complaint filed by Mr. Jeff Simpher
regarding geothermal installation services at his recreational property.
Project Overview and Initial Agreements:
Flynn Drilling Company was contracted in November 2024 by
Rehagen Heating and Cooling to install a 3-ton vertical geothermal system, with
completion aimed for April 2025. Our work included drilling, looping, fusing,
and installing the lines.
In March 2025, our manager met with Mr. Simpher's brother,
who approved the drilling site and line pathways, including a section through a
circular driveway. During this meeting, and as per our standard practice and
terms and conditions (Line Item 2), we explicitly informed Mr. Simpher's
brother that the geothermal installation would significantly disrupt the yard
and excavated areas. Our exact words were, "We will exercise all
reasonable caution, but the fact is that it will look like a bomb hit your
yard." We also stated that we backfill and smooth excavations but are not
finish-graders, and the customer would likely need to arrange for finish
grading and repairs. Mr. Simpher's brother acknowledged and agreed to this.
Installation and Initial Issues:
We completed the drilling and looping on March 18, 2025.
Installation of the geothermal lines and trenching began on March 31, 2025, and
was completed on April 1, 2025. During excavation, we encountered unforeseen
bedrock, requiring additional equipment. We also hit shallow, unmarked wires.
Mr. Simpher had previously assured us that any unmarked utilities were
inactive, per our terms and conditions (Line Item 3) and a discussion about
Missouri One Call locates.
On April 2, 2025, Mr. Simpher raised a concern about the
geothermal lines being stubbed in the wrong utility room location, which we
promptly corrected to his satisfaction.
Addressing Customer Concerns (April 2025):
A few days after our work was seemingly complete, Mr.
Simpher contacted us with two concerns:
Inoperable Water Well
Pump: He reported a broken power supply to his well pump. We determined this was
caused by the unmarked wires we encountered during excavation. We
considered this our oversight and immediately committed to repairing it at
no cost.
Driveway Ruts: Mr. Simpher stated the
driveway had "knee-deep" ruts from our excavation. Our manager
visited the site on April 16, 2025, confirming settling and rutting
(approximately 7 inches deep in the worst areas) exacerbated by 3.44
inches of rain between April 2nd and April 16th.
Despite our contract stating we are not responsible for
post-construction yard dressing, we offered to make an exception and repair
both the well wires and the driveway. Mr. Simpher agreed to this solution. On
April 18, 2025, we repaired the well wires and re-graded the driveway, mounding
the backfill slightly to account for future settling. Mr. Simpher expressed
gratitude for our prompt response.
Subsequent Issues and Our Position:
On the week of May 5, 2025, Mr. Simpher contacted us again.
Inoperable Geothermal
System: He reported an air pocket in the line, requiring a re-purge by Flynn
Drilling.
Recurring Driveway Ruts: He stated the driveway
had developed unacceptable ruts again, claiming they were impassable.
We scheduled a meeting with Mr. Simpher for May 12, 2025,
and our crew returned on May 13, 2025, to re-purge the system, ensuring it was
operational.
During the May 12th meeting, our manager attributed the
renewed driveway ruts to heavy rainfall (4.97 inches between April 18th and May
5th, totaling 5.17 inches by May 12th). Mr. Simpher insisted we bear full
responsibility for repairs and presented a $600 estimate from his contractor.
Our manager, despite our contract terms, offered to split the cost, paying $300
for the labor. Mr. Simpher declined, insisting we pay the entire $600.
Given our contract clearly states we are not responsible
for grading or dressing yards, roads, or driveways, and having already
addressed these concerns once, we informed Mr. Simpher of our decision not to
be further involved in driveway, road, or yard repairs. He then threatened to
contact the Better Business Bureau and state authorities. Our manager
maintained that we had gone above and beyond our contractual obligations. The
issue of a trash truck getting stuck was also raised, but we believe dumpster
location should be considered by the customer and trash company during major
excavations.Customer Answer

I have reviewed the business' response and am rejecting it because:The Vendor is telling only partial truths.
1.Yes, Flynn drilling did warn my brother that "during " the drilling stage my yard and driveway would: " look like a bomb hit it". They also reminded him that they were not responsible for "finish grading". But they also said that they would put things back the best they could after completing the work.
2. Yes, it is true they hit the wires going underground to my well pump while trenching. It is also true they repaired them...because the hit them! The lead onsite was told about the well wires in advance. NOTE: I have made nor complaint about the damaging my well wires ...they broke them and the repaired them...no issue.
3. Yes, they did have to come back after locating the Geo-thermal pipes in the wrong location within the house. The proper location was marked by the HVAC company in advance and reviewed with Flynn drilling. The crew placed them wrong and when notified Flynn did come back and relocate the pipes. Again, because they placed them in wrong place to start with and again, I did not make a complaint about this error either because they rectified it.
4. They did come back out to "burb" the air out of the system, but again this was because the HVAC company Tech deemed, they hadn't done it correctly the first time and the HVAC company called and had them return. Again, I did not complain about this, though it delayed the system start once more, and ultimately the system was operable.
5. Flynn states that they did repair the yard and driveway, but those heavy rains washed their work away. If they did, I never saw it in a repaired state and if rain could do this much damage it certainly was not done correctly. That driveway has been there for decades, and no storm has ever done anything like this.
6. Shane, Project leader for the job, met me onsite to review the condition f the yard and driveway. At the time he agreed that what he was seeing was not how they leave work sites (again also reminding me that do not do finish grading). He saw where a local garbage truck stuck in the sunken trenched area, he saw my front yard and useable driveway. He asked how I wanted it resolved. I replied either fix the driveway, hire someone to fix the driveway or reimburse me $600 toward the repairs. He asked if I would accept $300. I responded that $600 was fair. NOTE: I have two quotes for the repairs...one for $2,000 and one for $2,700. I realize Flynn is not responsible for finish grading and did not and do not expect them to pay for all of it. He left saying he thought that was fait and he he had to get it approved but it shouldn't be an issue, and he would contact me then ext day. The next day he called to say his mgt. refused to pay anything to fix the damage with no further explanation.
EXPECTED RESOLUTION: to fix my driveway, hire someone to fix my driveway or reimburse me $600 toward me getting the repairs completed.
I am happy to supply the estimates for the repairs if needed...just let me know how and to who.

About a month ago I had reached out to this company to help fix my washing machine not getting the right pressure. The guy, ******, came and **;worked**; downstairs for 5 minuets downstairs and left without charging me. 2 days later I went downstairs to find that the water tank was leaking, which it was not before. We had to call him back and at the time I was out of town in ********, and my granddaughter was the one who received him. All he did was tighten it, and now I am charged 150 dollars which I have paid, but honestly it seems like he is the one who caused it. Water pressure is fixed
