My family has been displaced from our home now for a month and nothing has been resolved. r they came out to fix the dip in the floor and to level. To do this they had to remove baseboards, cut, studs and cut into the drywall 3 days of work. They had to raise my floors almost 1/2in Then when the flooring company came out to replace the damage flooring, they found mold all underneath the vinyl flooring all over the subfloors. I immediately contacted the builder who first said they would put us in a hotel, then came back and said they weren’t responsible. Had a mold test done that said this type of mold is an aggressive type of mold that is typically found on wet construction materials. This was found on 11/6. Est to remove mold is $15,000 not including reconstruction. We hired a lawyer but nothing has been done. We can’t live in our home. We are living in a camper in a friend’s driveway without water due to the cold temperatures. We can’t cook in our camper due to not having proper electrical hook ups. It’s costing us money daily and we are still paying bills on our home.Business Response

I just got this email. Yes we are in discussions but it’s not currently resolved. The builder is asking me sign what is basically a gag order. We have been displaced from our home for almost 2 months now and they don’t think they should provide any monetary compensation for this.Customer Answer

More mold found. Was told that the house flooded from a bad spot in the roof the day before we were supposed to close. That the water came down the walls right in front of the master bedroom where one of the low spots where. The holes in the floor are drill holes to drain water into the basement and then swept into the drains.
My entire floor has to be replaced but instead of doing it the way it needs to be done, removing the cabinets and placing the floor, they want to just have the flooring butt upto the cabinet. My home is a new build and it’s done with the floors then cabinets to prevent curling but they don’t want to fix it that way.Also there is no access point into the attic in the house which is against fire code.

This home was inspection by two engineers prior to closing. This home received occupancy permits from both engineers one being a structural engineer. Both were requirements of the Consumers Lender prior to receiving funding for a Government FHA Loan. Builder has proof of Engineering reports and Occupancy permit. Home was also appraised for final appraisal the day before closing by the consumers lender appraisal company. Attic access is in the garage and meets all Lincoln County Fire Department Building Code. The Roof has never leaked. 30 year architectural shingles are on this home and there has never been any signs of any leaks. There is not a known cause of the mold under the floor. This could be from the Consumers 3 dogs freely urinating in the home. While no known cause of the mold has been found the Builder and flooring contractor have graciously been helping the consumer to get it cleaned up. The Flooring contractor is replacing the consumers floor. The consumers floor was on backorder until Feb so they even let her pick out a brand new floor and instead of just doing what needed to be replaced the flooring contractor is replacing ALL of the floor in the home so it all matches. The Consumer is not paying a single dollar. So no the flooring contractor is not ripping out cabinets, counter top, plumbing, etc. The Flooring Contractor guarantees their work and have already gone above and beyond. The Builder is offering to buy the home back at the full price of $351,000.00 from the Consumer to close in 30 days.

We have not received an offer for the full reimbursement of our home from Myer other than in this response so this isn’t a legal offer.
Myers also stated that they are replacing “ALL” flooring. This is incorrect. They are not replacing the bathroom floors or the carpet on the stairs so we can’t verify that all mold is removed.
As for the flooring that had been replaced, it is damaged and was installed knowing that it was damaged. It had tons of pin holes in it and creases in it and large scratches. As well as roller markers from when it was made.
We also found more mold on the underside of the subfloor in the basement from the mold in the kitchen and laundry room. It is evident that it ran between the boards. There is also mold on the insulation.

My name is ***** A. *********, and my firm and I represent Myers Select Homes of Lincoln County, LLC. My client is in receipt of numerous correspondences regarding Complaint #******** Re ******* ****. Myers Select Homes takes any complaint seriously and takes measured steps in its evaluation and response for resolution. My client and I have been working in concert with Mrs. ****’s attorney since mid-December pursuant to an agreement made with the ****s to make repairs/remedy issues. Work is currently being performed relating to the work. Since the BBB’s correspondence requests a response within 7 days, I wanted to be sure to give an update that work is being performed so that it is understood that Myers Select Homes is being proactive and responsive. As work is underway, I will be in contact with a response upon completion of the work, it anticipated to be complete by the end of the month.

I am rejecting this response because:The response was inaccurate. She stated there were four people present and it was just my husband and I. She also stated that she had contacted the electric company and they came out and said my washer was an issue. That is not true. The appliance company said it was the electric company. The electric company placed the ** but it is still doing the same thing. I also have replaced the washer 3 times. I cannot plug in my blow dryer that it's connected to. I have to plug it into the kitchen. There is also a crack in my tub that caused a quarter of my house to flood. I hired a plumber and he said it was faulty manufacturing. As far as the thing with the walk through, I have evidence I can provide. She also said she had to block me because I said something about an attorney. I did ask if I should involve my attorney, I did not state I asked.
ey dropped it off and it wasn**;t installed. I never yelled but I was frustrated, so my tone was not nice. They said they didn**;t want to talk to us because of my tone. There were nail pops. They blocked my number so I called them on my grandmother**;s phone and they said they are not doing business with us. There were still many things wrong that didn**;t get fixed. It was done months earlier. The warranty says by law that they have to communicate with us for 2 years. I want them to pay for all the costs that I put in to fixing the majority of all these things and to be compensate me for all the trouble I have been going through.

To whom it may concern,
See attached text messages between Homeowner and ******* electric. ******* is a Union Electrician and visited with the residence twice after closing. Issues came down to the plug on the washer that was switched out by the homeowner. Further to state the Homeowners rented washing machine from Rent- A- Center which she goes to to post on ******** on May 5th flooded their home. See attached post on ******** from buyer. ***** also posted photos on ******** which we have copies of. Buyer also received funds via ******************** by making a claim about said Washing Machine. There was no crack in the bathtub at the time of Final walk. Final walk list was signed by the buyers and has already been provided. ***** also sent complaint to ************************* of Missouri in which he denied of said issues from the Buyer.
