I signed a contract with Montana Quality Contracting on 8/5/2023 for a remodel of my house. We were told by *******************, the president of the company, that work would be done by Thanksgiving 2023. He then told us Christmas 2023. Starting in January 2024, ************** stopped working on our house and took on other projects instead. There has been shoddy work done and no effort has been made to correct the work by **************. He is blaming the subcontractors for the shoddy work. However, we did not hire the subcontractors, he did. We were required to pay for a port a potty for 8 months, but no work was being done, so no need for that. My wife ***** has taken over as the general contractor because ************** deserted us. ************** yelled at both my wife and me for not giving him enough time. This was in January 2024, and then he just left. We felt very threatened by his yelling. We have lost thousands of dollars by having to pay two mortgages, utilities, insurance, taxes, etc. while waiting for our remodel to be completed. There is still no end in sight. There are numerous construction defects that have been neglected. We gave ************** a drop dead date to complete of June 1, 2024. There has been very little done since January and there is still no end in sight. We are requesting a full refund from Montana Quality Contracting so that we can hire a contractor to fix the shoddy work done. We have paid Montana Quality Contracting $139,535.60 directly. However, we paid some of the subcontractors directly an additional $114,557.70 for a total of $254,093.30

      Business Response

Overview: The **** job was a major remodel that started in early August '23. At the start of the project, the ***** were aware that the remodel would be considered a fill-in project for us and our subcontractors and that the project would be completed in as timely manner as possible as supplies and subcontractor schedules allow. This is reflected in the contract wording and also in the fact that the contract had no completion date. There were several delays in schedules of subcontractors, which was anticipated and was ALWAYS communicated to them. The job was also hindered with a total of 31 change orders from the *****, most of which were major and also caused delays in the schedule. Specifically in January (since ***** mentions this), one of these major change orders occurred due to decisions the ***** had made- against recommendations. So we actually were re-remodeling the downstairs master bathroom while still trimming out the rest of the house in January. This isn't even taking into consideration the many, many times we had already completed something in the house, ************* decided she didn't like it, and ended up redoing things. Examples of this are: closet shelving, knick knack corner shelving, certain areas of trim, and bathroom cabinet placement just to name a few.

The ***** started moving in at the end of March, have been working out of the home, and have paid all of our invoices with the exception of the final draw which includes setting appliances, the plumbing final draw, and their shower glass, plus the remaining change orders that were completed (this invoice was sent on sent on June 26th). We have been about 99% complete since May and have been performing what we would consider verbal punch list items on an ongoing basis. We finally received our first written punch list from the ***** on July 9th, did a walkthrough for the punch list on July 10th, and were able to complete just one of those repairs via a subcontractor on July 11th. Since then, I have emailed the ***** on July 15th, 16th, 17th, and again on the 23rd asking them when we can be let in to complete the final punch list item repairs. To date, we have not been given a time to do so.

In closing: From the very beginning, we and our subcontractors have literally bent over backwards for the ***** to make them happy, which we now see might not be possible. Our company gave them a 3% discount for *****'s service- even though he is not a signer on the contract, we have performed work without billing for it, and we and our subcontractors have taken the lies about us and the bullying via texts and in person while maintaining a professional demeanor.

We will continue to ask the ***** to allow us to finish the final punch list repair list and are currently trying to resolve another perceived issue with them via another route.
