      Billings Livestock represented an agent ******************** who sold a horse to be online for $8750.00. The horse was a quality horse but not suitable for a total beginner rider as described. The agent Billings Livestock vouched for the consignor and said he was a long time client and could be trusted to replace or refund my purchase price. Billings livestock received my purchase price for the horse Marlboro. The consignor did not replace the horse in over 65 days. He then refunded the price less 25%. The auction house owes me *******. They basically stole this money from me. The horse was sold three days later for 6k more than my original price indicating there was no loss to the consignor or Billings livestock. This is unethical business practices. All attempts to discuss the matter were met with either unanswered phone calls from consignor or complete disregard from auction house to help intervene. This is unacceptable on every level to be treated in this manner.

      As set forth in our terms and conditions, Billings Livestock and It's associates act as agents only on all sales and are not responsible for buyer/seller error or misunderstanding.  All guarantees are strictly between the buyer and seller.  I have included a pdf copy of the terms and conditions.  Terms and conditions are included on our website and included in every monthly catalog.  It is my understanding that ************** had made phone calls prior to the purchase of her horse and understood what she was buying.  To my knowledge, she never saw the horse, rode the horse, or had the horse in her possession and decided AFTER her purchase that the horse was not going to work and returned it to the consignor for a potential trade for a horse that she thought may potentially work.  Keep in mind, she though this one would.  I had her call the consignor to work out the issue and details as we ARE AGENTS ONLY.   We do not guarantee rideability.  She bought the horse, plain and simple. The consignor has handled issues before in an upstanding manner.  I knew by my phone calls with ************** that it was going to take a lot to make her happy, and one may not be able to ever make her happy.  As it states in the info from BBB, you are asking that we respond to the complaint.  The complaint is between ************** and the consignor, not Billings Livestock.  Thank you for the opportunity to forward this information on and to better understand our position in the sale of horses through our facility.  Furthermore, it states that the issue be resolved to keep **************** business.  I do not care to do business with ************** going forward.  Thank you.  *********************, BLS Horse Sale Manager

      I reject the business owners accounting of the facts regarding the sale of the horse. I was told by Billings Horse auction they stand behind their consignor ******************** and opined he can be trusted to be true to his word. Both Billings auction and ******************** financially prospered  from the sale. ***** because he three days later sold the horse for an additional six thousand dollars and the auction house for receiving double commissions. Billings auction house failed to address any of these financial realities in their response.  Rather they continued to attack my character and make false claims about the transaction. ******************** had over sixty days to find a suitable replacement horse and came up with one that I agreed to and had it set to be vetted when the horse was no longer available to me. He came up with nothing else. The auction house received my money, received Double commissions, the owner of the horse gained six thousand additional dollars and both are defrauding me of $****.00. And the auction house wants me to just accept it all because they say so. Its unlawful. Unethical. And lousy business practices. I am owed $****. The auction house has received my full payment. They received double commissions. ******* later sold the horse for 15k. I am owed the rest of my purchase price of **** for the return of the horse. Plain and simple.

      Once again the agent of the horse auction who received my payment for the horse that everyone agreed would be returned for another horse and this one resold, believes its fair business practices to blame the customer malign my character and integrity and pantry to shame me by repeatedly telling me I should be embarrassed to have returned a horse that the owner and another seasoned horse professional said would outwalk pace wise its trail companions. I never questioned the quality of the horse I reviewed hundreds of ads in the auction and directly called all of the owners of the ad did not specifically claim the horse was suitable for all levels of riders and was beginner safe. This horses ad claimed a total beginner would be fine. I cant put a total beginner to go on a trail ride and have the horse out in front of other horses it simply is not safe. No seasoned professional would disagree. The ad when the horse was resold was changed to say most any rider can ride the horse instead of any rider can ride the horse. The auction house prospered by receiving two commissions and the horse owner prospered by selling the horse for 6k more than my original price. And both of these business owners think its totally acceptable to steal $2200.00 from me by withholding $2200.00 of the refund for absolutely no reason other than to be dishonest and unethical. No reason or explanation was ever provided why a deduction was made. The consignor refuses my calls, the auction house shames and blames me rather than doing whats right and working to resolve this fraudulent and dishonest action.   It is fully in the auction houses ability to resolve this matter and they sit by and do absolutely nothing. Its the worst customer service and business practices Ive ever encountered and I have a distinguished record of public service over decades of working with businesses and customers. The auction house and consignor are wrong. Morally. Ethically. They prospered and could care less the customer is wronged. They need to do better and care about their customers welfare and not only their own.
