    Charge of $62.45 for credit card processing fees 3.?? of Credit credit charge of $2144.19. Nowhere was it stated this fee would be applied until the full refund for serviced rendered do to poor workmanship.

    ***************************** was dismissed from my dental practice due to the inability to communicate with ****************** about his oral health in a professional manner. My office exceeded expectations and efforts to fulfill the needs and requests of ******************. After countless attempts to treat the patient in a professional and legal manner, it became unethical to keep ****************** a patient of record. 
    He was generously allowed the opportunity to receive his payment back for his dentures so that he could use his finances to seek his treatment elsewhere, despite no fault of my practice. He was formally dismissed from the practice and the finances of his reimbursement were explained to him. A check was written to ****************** for $3,660.00. ****************** arrived at the office to pick up the check on 07/16/2024 and the check was cashed by ****************** on 07/17/2024. 
    The credit card fee that his credit card company charged him for using his credit card on one of his payments was not reimbursed. This is a fee my office does not collect, but his credit card company collects for using their funds as a form of payment. At the time of the transaction it was explained to the patient that if he wishes to use his credit card there will be a standard 3% processing fee. ****************** was given the option to pay with a debit card, cash, or a check. The patient paid his previous payment with a debit card instead of his credit card to avoid the processing fee. ****************** was made aware of the credit card processing fee both times he submitted payment. 
    Additionally, not only was ****************** verbally made aware of the credit card surcharge, the card payment terminal lists the 3% credit card surcharge when checking out. I have attached an example of the visional the patient reads on the card terminal when checking out. ****************** signed for the amount being processed without concern or hesitation. 
    Due to the patient's choice to pay with a credit card despite being offered the opportunity to pay with several other forms of payment, and the fee is not collected by my office, it was not reasonable for my office to compensate for that expense. 
    After ****************** was dismissed from my practice and had been refunded, he came in unannounced and harassed myself personally and another patient I was treating at the time. ****************** started taking pictures and recording my office. The patient I was treating was worried about my safety and wanted to walk me to my car. That patient has offered to give a written statement on my behalf if needed. Due to Mr. ******** continuous harassment to my practice by his threatening behavior, I have been instructed by my attorney to contact the police if ****************** arrives back in my office unannounced.
