      I engaged Diamond Dust Construction services for the remodeling of our basement, which was scheduled to begin between February ****, 2023, as per the contract. However, the work didn't commence until the week of February 20, 2023, causing a delay of a week.As stipulated in our contract, I paid an upfront fee of $5,070 for initial project setup. The wood was delivered to the property on March 7, 2023. However, since then, there has been no progress on the project, and the contractor has not visited the property.Along with the $5,070 we also paid $4,150 for a new wood stove, but we do not have the stove.Our last communication was on April 3, 2023, during which we were to discuss closet doors. Despite repeated attempts on my part to get in touch with him, the contractor has not responded.The contract I signed with him stated that he shall "diligently pursue work through to completion" barring certain exceptions mentioned in Paragraph 17. To the best of my knowledge, none of the exceptions listed apply in this situation. I made all selections in a timely manner, no acts of God occurred, no pandemic or inclement weather were present, no strikes or lockouts were in effect, no extra work was requested, and no governmental impositions took place.I kindly request your assistance in resolving this matter. I would like the contractor to issue a refund of the amount paid for the wood stove $4,150 plus the majority of the initial payment of $5,070.

      Diamond Dust Construction understands the request for a refund. A full refund on the fireplace unit ($4150) and a 2/3 refund on initial payment ($3346.20) since work was performed with demo of flooring, drywall, and framing, along with disposal of waste material, pickup and delivery of flooring materials will be given. The refund will be issued via check sent certified mail within 30 days. We apologize if several contact attempts via email were not received, sent to spam or filtered out. However, we verified that contact was made with the contractor contact we provided. We wish you luck in your project.
