    Purchased a pure bred puppy and the breeder and she is now refusing to provide the paperwork required to register the puppy.

    This morning 4/13/2023 I had an email forward from **** that was a forward saying that I had not answered a complaint. I then went to the BBB site and messaged via chat and asked if the Complaint ID was in regards to me as I had never received an email message from BBB regarding this case. I was chatting with a person named ******. She then forwarded the messages and I did receive them at this time. I did visit with ********** about a puppy and he did purchase a puppy. I do not have a signed contract with him. He did not pick up a puppy in Montana from me, he picked up a puppy in ******** from ***************************. I have my contract on my website and anyone can print that contract but I do not have a signed contract with any sort of commitment to him. The attachment has his signature but nothing from me. I am not sure what he is asking. If he wants to breed his said puppy he would need to contact ******** and satisfy her contract to work toward that goal.

    I am rejecting this response because: PM Weimaraners emailed the contract to me with specific changes that I had requested.  PM Weimaraners is also very aware that I need both breeders signatures (her's and *****) on the registration paperwork to get this completed.  Additionally, the agreed contract required litigation in Montana.  I would accept the signed registration paperwork, with no breeding restriction, from PM Weimaraners, and an amended puppy contract that eliminates the Montana jurisdiction and specifies that the agreement was agreed to by *******

    ***************** has an unsigned sample contract he is attempting to use. This is not a legal binding contract. He bought a female puppy from ** in 2019 and picked it up in ********. He paid cash to ******** and at that time was suppose to sign an official contract. We happen to be in *********** where he claims to live and sent him a message in Jan 2020 to please meet us and sign an official contract and collect his NAVHDA paperwork for the puppy. He did not respond so ******** sent him the packet of paperwork via ***** We have heard nothing from him until a few months ago when he claimed to have no knowledge of us messaging or calling him while we were in ************** have screen shots with times and dates on my phone where we attempted to contact him with the paperwork. I also have screen shots of conversation where he says she is a Mainland dog and lives in **** and points ducks/birds/chickens etc on his family farm. 

    He demands full registration to his female in order to breed her without any health testing or proving she is of breed quality. Recently we acquired duplicate NAVHDA registration and both *** and I signed the registration and emailed it back to him. We also drafted a contract for him for breeding even though he has not done his part to prove his female worthy of breeding. He refuses to sign it and is somehow trying to hold us to a sample contract with no signatures, we have no idea if it has been altered or photoshopped.

    We do not sell puppies with any guarantee that they can be used in a breeding program without first passing health tests and performance testing and entering into a Breeding Contract agreed upon by all Breeders and Owners. This is nothing different than what we expect and prove of our own breeding dogs. Please view our websites for information on our own breeding programs. We are Preservation Breeders and hold ourselves to the highest standard when considering Breeding Animals within our program. This is important when you are producing hunting partners and pets that people expect to be healthy and have good temperament to interact within their families.

    I am rejecting this response because:

    First of all, beware of this breeder.  Now, ***** sent us the contract that she claims is a sample contract.  It is attached to this complaint and have very specific requirements for breeding and for a single litter of puppies.  Her sample contract has no such language.  The contract that she provided (again, attached) has no space for the breeder's signature, as the line has their names typed in the space where a signature would typically go.  They are misinformed about contract law and believe that because they did not sign the contract it is not valid.  In fact, the contract is simply a memorialization of the agreement.  I suppose that ***** could take the position that this was not the agreement, but our emails would paint a different picture.  I believe that ***** made the agreement without the agreement of ***, and *** is refusing to cooperate.  As to the "claims" to live in ************** can provide my driver's license and car registration, but I think that this is simply a red *******.  I appreciate the BBB's effort in this matter, but it is clearly a time for a hearing in court as the respondent is now clearly lying.  Again, beware.
