I had three roofs on my property replaced by American Roofing of Montana due to the windstorm of January 2021 and the work was completed by November 2022. My shed roof had a noticeable spot on it at the time of replacement but I was unable to examine it closer due to an injury. When I was able to get on the roof this past spring I found that the aggregate was gone from numerous shingles and I notified the contractor who said he would have someone come look at the roof. While waiting for a visual inspection I started looking at the garage roof and noticed numerous ripped shingles and linear seems on the roof. I notified Mr. **** that when his employee comes to the property for the shed roof that I wanted an explanation as to why the shingles weren't installed per the manufacturer's recommendation since they wouldn't be covered under their warranty. He replied that someone came to my property and didn't find anything wrong with either roof. I don't know how they missed the failed shingles that you can clearly see from the pictures I sent him. Since then ******** has stopped responding so I filed a warranty claim with the shingle manufacturer to determine if the shingle failure was due to a manufacturing defect or improper installation. I sent Malarkey a copy of the American Roofing invoice but it doesn't specify their shingles were purchased or installed. I sent them an email from ***** that he had installed their's but they want a receipt. The manufacturer and I have asked ***** numerous times for a receipt but he hasn't responded. All I'm requesting is a copy of the Malarkey shingle invoice so the manufacturer can determine why the shingles on both roofs have failed. After their determination, I will be trying to get the roof repaired by either the contractor or the manufacturer, which is why I believe Mr. **** hasn't responded as he may be liable. Look at those pictures and think if anyone should accept a new install to look like that already on a 30 year shingle.

This man is up to some sort of scam. We did his roof, and 2YEARS later he messaged me saying his roof looked like s*** (Due to a torn hamstring, Ive torn a hamstring and went to work within a week) So I asked him to explain what had him upset and he said the shingles were installed vertically (which is impossible). So I send a guy out to look over the roof and he did so and saw nothing wrong improperly installed, the missing granules in the picture are a MANUFACTURING WARRANTY ISSUE, not us being ignorant or doing something wrong. We have a 1 year warranty, technically I didnt even have to send my guy out, but I did anyway because thats what good people do. But his response was quite rude so I told him he can deal with the warranty claim himself since he wants to treat me with disrespect. His next email blew me away he sent pictures of HIS OLD ROOF and said this looks like absolute s*** and it needs to be fixed. So I responded and said ****, thats not even the roof we did! Thats your old roof! His next email he sent stated that he didnt mean to send those pictures ****** sent them by accident. Hes up to something here and I dont know what it is but all I did was respectfully tell him he can deal with the warranty claim by himself since he doesnt want to respect people and I think hes up to some sort of scam. And just so you understand, I would get paid by the shingle manufacturer to replace the shingles in the pictures but I respectfully declined because of the way hes gone about this.

I am rejecting this response because:  ***** hasn't provided the required receipt for the warranty claim. I havent responded to your insults in the past and Im not going to dignify your latest false accusations either. Per your invoice you sold me shingle installations on multiple roofs following the manufacturer requirements and they came with a 30year warranty.  Even you have admitted that the shingles have failed prematurely so Im still just trying to get the manufacturer to follow up on my warranty claim.  You were paid for this work so please send ******** and me the purchase receipt information requested so I can get this warranty work completed.

    Sincerely,

Weird how this injury stopped you for 2 years but you walked around the house every day we were there? Walked right up to me upon completion totally fine, no injuries. But you didnt crawl up there, why? Because it looked good! And I have 10 drone pictures to prove it. but Lie lie lie some more ****, bbb email me directly and Ill forward you our entire email including the email he sent me of the wrong roof saying this looks like s*** it needs to be fixed he then lied again stating that ****** put those pictures in the email, not me. You can also see in the emails as I just re-read them that I did not insult him, in fact the only insults in our entire conversation was him saying that his roof looks like s*** 2 YEARS after we did it. He was not injured upon completion, he walked around the house daily perfectly fine. I have done over 600 roofs the same way yours was done following the directions ON THE PACKAGE and you are 100% wrong on them being installed against malarkeys recommendation and that will show itself when no shingles blow off just as they havent. Oh and out of those 600 roofs weve done, only 2 SHINGLES have blown off in 14 years of me doing this so no, your roof is not improperly installed. My warranty is responsible for shingles blowing off and water leaks, so you have either of those problems? No, its in the contract we BOTH signed Youre on your own ****, you received a receipt upon completion and you lost it. Tough luck, be better and learn how to respect people and maybe youll get better help. Honesty goes a long way too and re-reading our emails your latest response was full of lies and I got the emails to prove it. Email me directly bbb at ******************************** and Ill let you read for yourself.

I am rejecting this response because:I see that I did attach the old roof pictures in one email so that was my bad but it doesnt mean I was trying to lie, actually I plan to use the emails in court if needed. Ive attached a marked up picture from 10-21-2022 of the shed roof by highlighting the damaged area (in red) which was right after install that I notified you about. I also attached a picture from last year that shows the aggregate from the same area (in red) at the point of failure in less than 2yrs.  The garage marked up picture shows the shingles installed vertically by the racking method (in yellow) which you said was impossible to do but its clearly visible in the picture along with some damaged shingles (in red) and the whole roof is done this way.  Ive attached the manufacturers racking technical bulletin which states shingle joints align every other course, and this increases the chance for roof leaks. You say Im lying and a scammer but these pictures prove they were installed this way and if you would have come out here and looked like I repeatedly asked, you would know that.  Ive attached the manufacturers installation instructions that shows the correct staggering of the **** joints which isnt how they were installed. Your invoice states that you were going to install the shingles in accordance with those recommendations but you clearly didnt.  I did say the garage roof looks like c*** because it does, ******** puts it a little nicer way by saying it creates objectionable patterning.  They also state that by racking the shingles they have reduced wind resistance and are increasingly susceptible to blow-off plus the act of lifting shingles to apply the fasteners can create stress cracks that weaken the shingle which can lead to warping or curling, loss of seal-down and granules which the roof has in the pictures I provided.  ******** states that racking shingles isnt covered under warranty for architectural shingles only 3-tab shingles. The old roof you replaced had failed due to wind damage and I didnt pay $20k for my new roofs not to be covered under a 30year warranty that you said was provided both verbally and in writing. I didnt lose the receipt, you never provided one as I have both of your invoices. If you have nothing to hide then give me the receipt so Malarkey can do a warranty inspection or reinstall my roofs in accordance with the manufacturers specifications.

    Sincerely,

    **** ********
