Background: My wife, ***************************, has been a customer of the ********************** for several years. In 2022, she moved from Helena, MT to ********, **. She continued to use Valley Bank for her banking needs by using their official app on her smartphone and calling the Helena branch. Incident: On July 23, 2023, ****** was the victim of a scam involving falsified e-checks. She realized she had been scammed 3 days later. On July 26, she contacted the Valley Bank of Helena, along with the ***************************** to report the scam. ******'s call was sent to the ******************* ****** told her that, under the terms and conditions of her account, she is liable for all lost funds and is required to repay the new balance of almost -$2000. She was told her account could avoid going to collections if she deposited $50 into the account by the 15th of each month until it was paid off. ****** agreed to this arrangement. In early August, ****** noticed that her account was accruing daily overdraft fees. We also realized that the app was no longer allowing her to remote deposit checks into the account. After multiple phone calls over the course of a week, ****** was able to speak with *** at corporate who clarified that: 1. The account will continue to be charged overdraft fees every day that it has a negative balance.2. Meehka will be unable to use remote deposit and needs to visit a physical bank location to pay off any amount of the debt. The nearest location to our home is several hours away by car.3. Even if we elect to pay off the debt via creditors, the account cannot be sent for debt collection until a set number of days have passed with a negative balance. During this time, fees will continue to be levied, increasing the ultimate amount of the debt.

I am rejecting this response because:

Firstly, we would appreciate if ****** could give us the courtesy of spelling our names correctly.

Second, we find it hard to believe that the fees cannot be halted nor the account frozen because the account owner was maliciously tricked by a third party. It seems to us that, instead, the bank is levying it's own punishment of $5 per day on ****** for falling victim to a scam. This also flies in the face of the payment plan that was established between us and the bank, namely that of paying $50 a month to prevent it from going to collections. At the rate we are being charged, the debt will increase by $100 every month, despite actively paying it down. That is unreasonable and predatory.

      Sincerely,

      *******************

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.

The account owner has notified me that many of the fees have been reversed on her account. We will continue paying off the debt according to the payment schedule agreed upon with the bank.

      Sincerely,
