I went thru LC Staffing for a job w/ Badlander for Alcohol Catering. The contract LC Staffing had for Badlander requird me to work 800hrs. After 6+mo I've worked 100hrs. ********* wants to hire me, but LC Staffing is requiring I work the remaining 700hrs. That would take me 4yrs to complete. I'm 41yo & only take a few events per month. LC Staffing is attempting to own me. It feels scary & predatory. I never signed any contract w/ LC Staffing. ********, is the LC Staffing representative to contact.

      Business Response

      Date: 04/28/2023

LC Staffing has an established service agreement with Badlander, under which LC employees will work an 800-hour contract period, or the client will wait one year from the date the employee was introduced to them by LC. Once one of these conditions has been met, ********* may choose to hire the employee directly without a fee. For a full-time employee, this equates to approximately a 5-month contract period. This contract period allows LC Staffing to earn our fee from our clients over a period of time.

************** has worked for LC Staffing, assigned to Badlander, for just under 100 hours since 09/11/22.  Releasing our client from the 800-hour contract for ************ is problematic for two reasons: (1) To require that other employees work the full 800 hours and not ************** could be perceived as discriminatory practices, and (2) 100 hours of service worked does not cover LC Staffing's costs associated with recruiting, screening, and payrolling ***************

************** was advised of the 800-hour requirement during the new employee orientation that she participated in prior to starting her assignment with **********  When ************** reached out to us with a complaint regarding the 800-hour requirement, LC Staffing reached out to ********* and offered them a reduced contract buyout fee that would allow ********* to hire ************** immediately.  ********* has refused this offer and indicated they will continue to offer assignments to ************* until 09/10/23, when the one-year term requirement has been met.
