    I am filing this complaint against TS Firearm for fraudulent and unethical business practices. The seller engaged in deceptive tactics to avoid fulfilling a legally binding auction sale.Facts of the Case Auction ************* Attempt to Avoid the Sale I won a no-reserve auction for a firearm at $2,275.00.The firearm retails for $2,999.00, with the lowest price I found being $2,650.00.The seller had previously stated they made very little profit at that price, indicating they were dissatisfied with the final auction price and sought to avoid the sale.I mailed a check within the required timeframe and provided proof of delivery.The seller delayed processing, later claiming non-receipt or potential theft but never requested an alternative payment.The seller falsely cited a payment policy violation to cancel the sale and relist the item.Admission of Financial **************** Fraud The seller admitted they wanted to avoid paying GunBrokers final value fee and pressured me to cancel.They blocked communication and refused to process my payment to force cancellation.When I refused, they relisted the firearm instead of honoring the original sale.The seller blocked me on GunBroker, Their actions show a pattern of manipulating the platform to cancel unfavorable sales while unfairly penalizing ************ Basis for Complaint Breach of Contract: Failure to honor a legally binding no-reserve auction.Deceptive Trade Practices: Misrepresented willingness to sell, engaging in bait-and-switch tactics.Consumer Fraud: Manipulated the auction system to induce bids while retaining the right to cancel.Unfair Business Practices: Used deceptive means to void a legitimate sale.Requested Actions Delivery of the firearm I legally won at auction and paid for.

    Sales transaction not complete because never received the payment.  Payment policies and payment method were disclosed when buyer check out and finish process checkout.   Payment needs to be received within timeframe of 6 days.  Never received payment within the timeframe when payment need to be made and therefore the sales was never complete, and transaction was cancelled.

    I am rejecting this response because:

    Timely Payment Was Mailed and Delivered

    I mailed a check within the seller's required 6-day payment window. The payment was tracked via **** and marked as delivered to the sellers listed address. I also filed a claim with **** to confirm the delivery. The Postmaster of Lolo, MT provided confirmation based on GPS scan data that the parcel was delivered correctly to the sellers location.

    Seller *************************************************start="948" data-end="951"> Despite their claim of non-receipt, the seller never contacted me to request a replacement payment or suggest any alternative form, such as credit card (which they accept). Instead, they unilaterally canceled the transaction and falsely cited a payment policy breachdespite having clear proof of delivery.

    Seller Admitted to Not Wanting to *****************start="1312" data-end="1315"> In direct communication, the seller stated they would not fulfill the sale unless I agreed to cancel the auction, which would allow them to avoid GunBrokers final value fee. This shows their motive was not about non-payment, but about dissatisfaction with the final auction price and a desire to avoid financial obligations.

    Seller Delayed and Manipulated the *****************************start="1714" data-end="1717"> The seller delayed action on the payment, then initiated cancellation without providing time for resolution. This demonstrates an intent to control the cancellation terms rather than make a good-faith effort to complete the transaction.

    No Refund or **********************start="2304" data-end="2307"> To date, I have not received my payment back, nor have I received the item I legally purchased through the auction. I would like the seller to fulfil the auction and send the item. If the seller claims they do not have the check, I can have the same check re-issued and I can send it express mail with signature required. The seller does not want to sell the item for the price I won it for, if they did they should accept this offer.

    I am rejecting response from Mr. ****** for these reasons which I am sure BBB will forward this to him: 

    Payment was never received in the 6 day payment window, even until now we have not received payment or check. Regarding other payment method, customer is fully aware of what payment we offer, and he chose to select ****/ Certifed check as his payment method.  Customer chose this method most time to avoid credit card fee.  

    We had to pay for fees associated to an item that the Mr. ***** did not fulfil on his end due to nonpayment and he falsely create another account with false address and won the item again and in good faith, we are willing to work with him a second time to resolve issue.  He did not send payment nor provide tracking for the second item, when he responding he will, but have not heard from him regarding this transaction, which resulting in Mr. ****** not fulfiling his obligations a second time as a consumer and not getting the product.  Due to this nonpayment both is account from GB has been shut down.

    To date we have not received payment and therefore cannot return his payment but if Mr. ****** can provide proof payment of check was cashed by TS Firearm, we are more than happy to send item to Mr. ******* Mr. ****** can get his fund back and have address a few about canceling the payment, but choose not to. 

    BBB and Mr. ******* this will be my final response and as Mr. ****** as threaten me these past few month of suing me and any more issue regarding this matter please contact my attorney Mr. ***** and he is more than happy to assist in this matter. All fees associated from this matter on wards will be Mr. ****** responsiblilty.  His information:

    I am rejecting this response because:

    I did provide proof payment was made and delivered in a timely manner. There was a **** investigation and the check was delivered to the correct address. All evidence has been submitted to the bbb. The seller used deceptive practices to avoid fulfilling a legally binding auction because they were unhappy with the final sale price. They had no intention on sending the item. The entire situation has already been explained in detail in previous correspondence with the bbb. If this was simply a problem with payment they would have accepted another form of payment.
