TERMS AND CONDITIONS
THIS AGREEMENT IS LIMITED TO THE PREVENTION AND MANAGEMENT OF THE FOLLOWING PESTS:
General insects including spiders, common ants, cockroaches, wasps, flies, millipedes, box elder bugs, etc. that are commonly found
in the Western Montana climate. Unless specifically noted above, this Agreement does not include infestations of bed bugs, fleas,
carpenter ants or mosquitoes. Unless specifically noted above, infiltration of vertebrate pests such as bats, birds, squirrels, pocket
gophers, ground squirrels or voles can be addressed as needed, but is separate from this Agreement. Please be aware that special
situations of infestation may require extra treatment with specialized equipment and products. Special situations of infestation will be
addressed on a case-by-case basis and a separate comprehensive bid will be provided.
This Agreement is subject to review and may change as processes or materials are changed and/or improved, which can result in
changes to frequency of service, service warranties, and service fees.
This Limited Re-treatment Contract between Montana Pest Solutions and Customer applies only to the Structure(s) listed above. This
Contract does not apply to other buildings or structures at the Property Address unless specified in writing. Montana Pest Solutions
will provide services for prevention and management of the pests specified above only. This Agreement does not provide for damages
arising from the infestation of any wood-destroying organism.
1) SERVICES: Montana Pest Solutions will provide the necessary services to prevent or manage the specified pests. Montana Pest Solutions has the discretion to
use the types of products and services which, in its sole judgment, are appropriate to achieve prevention and management If products are applied, the application
will be in accordance with the directions of the manufacturers of the chemicals, U.S. EPA registered labels, and the requirements of federal and state laws and
regulations.
2) PERFORMING THE WORK: Montana Pest Solutions will exercise reasonable care while performing any work. Under no circumstance or conditions shall
Montana Pest Solutions be responsible for damage caused by Montana Pest Solutions at the time the work is performed.
3) RENEWAL FEE & INSPECTION: This Contract will renew on an annual basis beginning January 1 of each year unless either party gives notice in writing, at
least thirty days prior to the anniversary date, of its election not to renew the Contract. Montana Pest Solutions reserves the right to adjust the renewal fee annually
by written notice, whether provided by regular mail or electronic communication containing a delivery and read receipt. Customer shall have the right to terminate this
Contract, notwithstanding the thirty (30) day notice requirement, upon receipt of Company's written notice of increase in fees.
4) CHOICE AND/OR CHANGE IN LAW: This Agreement shall be interpreted, regulated, adjudicated, and governed by and construed in accordance with the law of
the State of Montana. Should any federal, state or local law or regulation change regarding Montana Pest Solutions' services or treatment, Montana Pest Solutions is
authorized to take whatever steps are necessary to maintain compliance with said laws.
5) NON-PAYMENT: Customer agrees to pay Montana Pest Solution's invoices upon receipt. Montana Pest Solutions reserves the right to terminate this Contract if
payment is not received within thirty (30) days of the date of invoice. In the event legal action is necessary to collect any amount due to Montana Pest Solutions,
then Montana Pest Solutions shall be entitled to recover from the customer all reasonable costs of collection, including reasonable attorney's fees and expenses, in
addition to any outstanding amounts owed to Montana Pest Solutions.
6) LIMITATION OF DAMAGES: Montana Pest Solutions makes no warranty or guarantee that pests will not invade the structure after its services. Montana Pest
Solutions is not responsible for any damages for loss of use, loss of income, or other consequential, personal injury or economic damages, including from insect
bites, stings, or infestation. Montana Pest Solutions disclaims any liability for special, incidental or consequential damageTHERE ARE NO GUARANTEES OR
WARRANTIES, EXPRESSED OR IMPLIED, EXCEPT THOSE SPECIFICALLY STATED HEREIN. THERE ARE NO WARRANTIES OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE. Montana Pest Solutions' responsibility is limited to re-treatment of the Structure as noted above. Montana Pest
Solutions bears no responsibility to inspect for, treat, repair or to pay to repair damage caused by any wood destroying organism.
7) CUSTOMER OBLIGATIONS: Montana Pest Solutions' liability under this Contract will be terminated if Montana Pest Solutions is prevented from fulfilling its
responsibilities under the terms of this Contract by circumstances or causes beyond the control of Montana Pest Solutions.
Pests may be attracted by conditions solely under the Customer's control. Customer shall follow Montana Pest Solutions' recommendations and advice regarding
pest prevention and management.
Service appointment cancellations must be made 48 hours before scheduled appointment or a $50.00 no-show fee will be charged. Appointment cancellation must
be made via phone call to (406) 830-8752, or by e-mail or hard copy letter.
8) ENTIRE AGREEMENT: Attachments, if any, together with this Contract signed by Montana Pest Solutions and Customer at the time the Contract is entered into,
constitutes the entire Contract between the parties and no other representations or statements, whether oral or written, will be binding upon the parties.
DISCLAIMERS AND NOTIFICATIONS
CAUTION – PESTICIDES ARE TOXIC CHEMICALS. Montana Pest Solutions applies pesticides which are registered
and approved for use by the United States Environmental Protection Agency. Registration is granted when the existing
scientific evidence demonstrates that there are no appreciable risks if proper use conditions are followed and that the risks
are outweighed by the benefits. The degree of risk depends on the degree of exposure, so exposure should be minimized.
If within 24 hours following application, you experience symptoms similar to common seasonal sickness, comparable to the flu, or
other symptoms of overexposure not typical of influenza, contact your physician or Poison Control Center (800)
876-4766 immediately. If rodenticide ingestion occurs, you may experience symptoms of mild shock and/or bleeding.
This is an anticoagulant reaction and you should contact your physician or poison control center whose phone number is listed
above.

9) CHEMICAL SENSITIVITY: If Customer or other occupants of the structure(s) or adjacent buildings believe they are or may be sensitive to pest management
products or their odors, Customer must notify Montana Pest Solutions in writing, at least three (3) days in advance of treatment, including whether Customer or
other occupants have consulted with a medical doctor or other healthcare provider regarding such sensitivity. Montana Pest Solutions reserves the right, upon
receipt of such notification, to deny or terminate service.
10) BUYER'S RIGHT TO CANCEL: You, the buyer, may cancel this agreement at any time at least two business days prior to your scheduled service. Cancellation
must be in written form via electronic mail, hard copy delivery, or by speaking directly to a Montana Pest Solutions representative.- Business Categories
