    Looking for custom kitchen cabinets we met with ******* and ***** ****** (owners of *** and ***************) in early August 2024 to discuss the kitchen plan, design, and cost, and selected this business to make our cabinets for us. The cost would be approximately $80,000. We wanted to pay *** *** ***** their fee. *** *** ***** said we needed a General Contractor to remove our existing cabinets, move the appliances, sink, countertops, prepare the dry wall, painting, electrical and plumbing to prepare the area for the new cabinets (as they are not licensed to do that work). They suggested ***** ****** whose business is called Half Moon Hollow Development and Design LLC. They also said that everything would go through Half Moon Hollow. When we met ***** ******, he invited us to see a house with cabinets from *** *** ****** He made it seem like he was involved with the cabinets, as he proudly showed them off. He even told a story when ***** ****** (cabinet maker) had a tricky cabinet that would not fit, and was called, and came over immediately to help. ***** ****** created a scenario of how important he was to the cabinets. The ********* had already planned and measured for the cabinets with *** *** ***** a month before meeting ***** ******. We were blindsided by ***** ******, as he was misleading into how involved he was with the cabinets. Truth is he is not involved at all. He does not create, build, or install the cabinets. But he would like you to believe he is involved, so he can wrap that company into one of his subcontractors to take a large 25% builder fee. From ***** ******** spreadsheet, cabinetry and hardware was $79,363.45, and 25% of that is $19,840.86! This is dishonest, unethical, immoral, and fraudulent. We want $19,840.86 to be refunded immediately, as he is not involved with any aspect of the cabinets, as we brought *** *** ***** to the table. He should be entitled to 25% of $22,296.92 from his subcontractors which would be $5574.

      ******** did go to the custom cabinet makers for a kitchen remodel.  However, the owners did not tell them they had to have a General Contractor to do the project.  The owners of the company will attest to this.  We called the ******** and requested a meeting as we always do with new clients to see the project and to meet the clients.  We went to their house and they told the scope of the project.  The ******** requested to see one of our projects that also includes cabinets from the cabinet makers.  We took them to a full high end custom kitchen remodel we had just completed which included custom cabinets from the cabinet makers. We left that meeting and told them to reach out to us if they wanted to proceed with us as the General Contractor over the project.  They called and said they wanted to proceed.  We meet with the clients with a complete scope of work that clearly shows the cabinets are designed, manufactured and installed by the cabinet makers, not HMH. This was signed by all parties on 9/11/24.  We also presented the ******** with a line item budget break down of every trade that was to be involved and the estimate of each trades cost.    I read the contract line by line and it clearly states we are a cost plus builder that charges 25% of the entire project we are overseeing.  The cabinets were in the line item budget and we were overseeing the scheduling of the entire project as well as working closely with the cabinet makers to circumvent possible problems.  The contract states we are cost plus 25% several times and I pointed this out.  This is our standard fee for all our projects. The contract cost is shown as $129,786.89.  I again asked if they had any questions or hesitations and they said, "No", both willingly signed the contract and wrote the initial deposit check. We completed the project according to the scope of work and the cost reflected in the contract.

    I am rejecting this response because: The contract with ***** ****** Half Moon Hollow Development and Design we discovered is considered fraudulent and predatory.  All documents have been submitted to the BBB.

    We are not satisfied because we want a refund of $19,840.00 for their 25% fee of *** *** ******* custom cabinetry.  ***** ****** had nothing to do with the design, installation (a separate fee to *** *** ***** ), scheduling, or overseeing the project.  *** *** ***** called and communicated directly with us.  I personally sat down with ******* ****** 3 months prior to installation.  ***** ****** did the custom cabinetry, installation and punch out.   This is why ***** ********  contract is predatory.and fraudulent. ***** ****** was not onsite for the installation,  punchlist/touch ****  ***** ****** showed up .  A video will be presented (if necessary),  of ***** ****** trespassing.)..  That anything he needed could have been communicated via e-mail.  The cabinets were  100% supervised by myself ******* *******.  We asked about his 25% fee, his response (this is how we make our $$). We had already signed and committed to *** *** ******

     ***** ****** of Half Moon Hollow Development and Design LLC works predatory and frauldently with *** *** ***** cabinetry.  To date there has been no communication or willingness to mitigate the refund requested.  We have a case manager  with the Attorney General Consumer Protection in **********.  We are pursuing a case with the ***********************************.  We would be willing to retract these complaints and the investigation of his land purchase in October 28, 2024 *********************  in *********** ** with our initial $70,000 deposit on 9/11/2024.  Demolition did not start until November 20th 2024.   

    With all 3 entities now being contacted and reported .  If ***** ****** doesn't not refund is the $19,840. We will file a lawsuit 

    2 separate contracts 2 separate fees is fraudulent.

    Please see attached docs between HMH and *********  *** does many projects with *** and every project has 2 contracts to protect clients and make sure everything is done to scope and specs to substantial completion. This project is no different. Our contract states ******** are to come to us through private mediation if there is an issue like this. They have not.  The contracts referred to are proof ******** knew HMH did not design, build or install the cabinets, but according to our contract our fee covers oversight, ALL materials and ALL Labor of the complete project.  We were on site during all the demo, paint, electrical, plumbing, cabinet install countertops and backsplash. We were not onsite with *** punch as we never do this on any project with cabinets.  They did ask about our fee and I explained the contract but I never said its how we make our money.  We did not seek out the ********, it was a simple referral.  We were completely transparent with pricing and what we do.  The ******** are in breach of contract as they never came to us with these complaints, the first we heard was from the BBB. We had no way of knowing there was anything wrong which is why we have not approached them.  As to the trespassing, if you want a transcript of the texts that lead up to this I will send.  Our electricians came early to fix a strip light and she was furious we were not there but were on our way. Then told us not to come, but we had to go to do the punch list and check the repairs. Lastly, our personal land was purchased with personal funds completely unrelated to ******** with a clear paper trail.  The $70000 ******* deposit was dispersed, the day after the check was written, to *** deposit, Granite Depot for Deposit, and Tile purchase with a paper trail. The reason the project was delayed was Hurricane ****** which happened 2 weeks after the signed contract.  We have a clear paper trail for all funds from *********
