On August 15, 2024, ****** ****** purchased a Travel Trailer ** from Carteret RV in ***********, **, to be used as a residence. ****** was told by the salesperson, **** ********, that there were no leaks or soft spots. We have attached a text chain of **** being asked directly if there were any leaks or soft spots and his response was: everythings great. We believe this was a material misrepresentation and the ** was purchased under false pretenses, a felony under NC Law, Article 19 14 100 and the sales contract is void.Immediately after the purchase, ****** discovered black stained flooring under the carpet which we believed was previous leaking. The first substantial rain resulted in leaking in multiple spots. On December 10, a 3-inch gap opened in the ceiling of the **, exposing it to the elements, making the ** uninhabitable. On January 13, we emailed Carteret RV owner, ***** ******** and requested he take back the ** and return our money. On Feb. 8, ***** inspected the camper. ***** his findings are the damage was caused during transport to its current location. Moving the camper to its current lot in ****** would not result in soft, rotten sub-flooring which is what caused the current structural failure and gap in the roof. Three other people, the insurance adjustor, the repair company, and ******** landlord say this shows evidence of long term damage, not of sudden damage from transport.On Feb. 11, ***** provided a repair estimate of $2116.78 and offered to pay half the repair costs. My repairman, who inspected my camper in December, stated that the fix ***** is offering adds new flooring on top of existing, rotten flooring which would not fix the issue but rather cover it.Apparently, the prior owners had already tried putting more flooring on top of the rotten floor resulting in the current structural failure. It is unfathomable to us that Carteret RV did not know this when they purchased the vehicle for resale and sold it to us.Business Response

The customer clearly had expectations that were not met. We do our best to sell both new and used campers making sure we meet the customers' expectations. Whenever we receive a trade in - which is what this camper was - before it is sold, we do a mechanical check out which includes the appliances and electrical and gas components. We don't test the unit for water issues due to the fact that almost every camper spends the majority of its life outside and water issues would be fairly evident. All campers are available for inspection and this particular customer inspected the unit multiple times and also had her father do so. Most 15-year-old campers will have some kind of issue that will need to be dealt with. We liken it to a vehicle with high mileage. If one were to purchase a vehicle with high mileage, would you expect it to have issues after purchase? The customer even stated in her text thread that it "fits her needs perfectly. Been loving it so far". The last thing I will mention is that we have an as-is with no warranty document that the customer included as an attachment. We have the customer sign this to acknowledge that if there is a problem after the purchase, that we are not responsible. It seems somewhat problematic to sign this document agreeing that this is the case and then claim that we are responsible for the issues that have arisen. Even though that was done, we offered to do a repair to the unit that we believe was satisfactory due to the age and value of the unit. The customer as stated already has turned down our offer. I am not sure what other resolution the BBB could come up with, but I will be glad to listen.

I am rejecting this response because:I signed an "as is" contract, yes. But the as-is that was clearly stated to me by the sales person, ****, was no leaks or soft spots. Everything is great.
If Carteret RV does not inspect its inventory for water damage, why did the salesperson say: Carteret RV runs water over the roof for 24 hours to check for leaks? We have two witnesses to that statement made by **** on our first visit to look at the camper.
We are claiming misrepresentation and false pretenses regarding the "As Is". **** should have said, we do not test for leaks or soft spots. Instead he said, everything is great when asked a direct question about leaks and soft spots.
And we have ****** statement captured in a text message exchange.

I bought a travel trailer from Carteret RV for $10,580.45 and it was shipped to my lot on Friday August 30th. I was told by the sales person I was working with that the travel trailer would come with two full propane tanks and a set of steps that would be put on outside of the glass door. There were no steps when we went to look at it, but were told that they would be put back on before it arrived at my lot. When it arrived at my lot, there was only one propane tank that was partially filled, and the steps were completely non-functional and broken. I texted the salesperson about this issue and they said they would provide me with another propane tank by September 1st. **** ********* 2nd had arrived, I had still not received a second propane tank. I was also told over text that the salesperson would contact their service department and try to have somebody over on September 3rd to look at my steps that came broken. **** ********* 3rd came around, I had still heard nothing from the salesperson. I then proceeded to text him and he said that he was sick and would be back in the office tomorrow, September 4th, and would contact somebody in the service department to come look at my steps. I texted him on September 4th, the day he said he would be back in the office, to confirm that he had talked to somebody in his service department, and I still have not received a text back. It is now September 19th. I contacted their main office, and they spoke with the general manager and the head of the service department. The head of the service department stated that they had heard nothing from the salesperson about coming to look at my steps. They said that they wanted to talk to the salesperson I was working with before proceeding. They said he would be back in the office on September 16, and would contact me then. It is now September 19, and I have been waiting 4 days for a call and answers from them, and have not had anyone reach out to me.Business Response

There was a miscommunication between the salesperson and the customer and during that exchange, the salesperson has quit. There was never an attempt to not address the issues. We were waiting for the salesperson to return to determine what needed to happen. Instead of trying to substantiate claims made by the former employee, we decided to respond to the complaint by providing the customer with replacement items for the items needed. The customer has been made whole and has received the needed items at no charge. We are considering this issue as resolved and wish for this to be dismissed as a complaint.Initial Complaint

We purchased a brand new ** from this company on July 3, 2022. There were a few items needed fixed/replaced. We returned the ** to them on July 5, 2022. They stated they would fix all issues with no problem. After 3 months of going back and forth they claim they needed authorization from warranty company. We called the warranty company and they said the authorization was some how missed but approved it and sent it to the company. This was October 2022. The warranty company was called again in November 2022 and we were told the company received the parts 11/11/22. We have called the ** company NUMEROUs times and we never get a return call back although they say they will. Its now been 6 months since we turned in our brand new ** for warranty work and we have no word when it will be done. We have made 7 payments on time for this ** to sit at their facility and nothing is done. Not to mention we only have a 1 year warranty and its exposed to elements (ie weather) which can cause issues to the top of the ** or seals etc. There has been no communication on the ** companies part. We literally used the ** 3 days but have made faithful payments for 7 months. We would love to have a full refund on this **.
