    Last year, my daughter was a part of Cheer Athletics located in Charlotte, **. Very early on in the season the teams began implementing very concerning and unreasonable expectations and rules for the athletes to include having to still be in attendance at practices sitting in the sidelines when an athlete is sick or injured. Shortly after these regulations were being implemented a new version of the Terms and Conditions was sent out on September 20, 2023 stating that an early termination fee of $309 would be charged if any athlete chose to leave the team. I DID NOT sign this new policy because I DID NOY agree. On September 24, 2023 I submitted an email resignation for my daughter. I never signed the new policy. Since then, Cheer Athletics has continuously tried to withdraw $309 from my account. On April 2, 2024 I asked ****** (last name unknown) via email for my written agreement to pay this early termination fee. ****** told me Id be receiving a copy of this in a separate email and I never got that email. On October 4, 2024 Cheet Athletics charged me $309 without my consent. I immediately contacted the office and requested a refund. I was told I would receive a call back immediately and I have not. I am concerned that they are currently attempting to doctor documentation to appear as if I signed Terms and Conditions I did not agree to per their year-long persistence with trying to charge my account without providing me written documentation showing I agreed to the charges.

    ***** ****** electronically signed the Cheer Athletics Charlotte Rules, Terms and Conditions, which specifically outlines the Early Resignation Fee, on June 25, 2023 at 8:20pm. This is verified on the Electronic Confirmation attached to the Rules, Terms and Conditions document. 

    Korens account was charged for the Early Resignation fee in the amount of $309.00, as outlined in the Cheer Athletics Charlotte Rules, Terms and Conditions, on September 23, 2023, after informing Cheer Athletics Charlotte that her daughter would be leaving the program. On October 11, 2023, Cheer Athletics emailed ***** regarding the outstanding balance on her account for the Early Resignation Fee, to which no response was received. On April 1, 2024, after several unsuccessful attempts to collect the fee, ***** sent an email to Cheer Athletics Charlotte asking if she had signed a contract agreeing to pay a resignation fee. On April 2, 2024 Cheer Athletics Charlotte replied to ****** email confirming that she did sign the contract, and a copy of the contract was emailed to Koren. 

    The next communication was not received until October 3, 2024 around 7:30 pm, when ***** phoned the business office at Cheer Athletics and was very abusive in her language to the employee who took her call. She repeatedly cursed at and demanded that the fee was refunded to her immediately. The employee told her that she would forward the message to management who would get back in touch with her. The employee did not state that she would call her back immediately as it was after business hours and there was no management in the business office at that time. 

    ***** agreed to and accepted the Rules, Terms and Conditions and was charged the Early Resignation Fee in conjunction with the signed agreement. Cheer Athletics Charlotte has chosen to refund this fee to ***** as a gesture of goodwill, however her account will show that she still owes the fee, and her account will be suspended until this fee is paid in full.
