    Early this year, around May 2024, we had solar panels installed on our home by Lumio/ *******. They have told us that they used JW Bernard as a 3rd party installer for the project. The installation went smoothly and, as far as I know, the panels are working well. There is an interconnection agreement/ contract, as well as a one-line drawing (as well as an application fee, but I am honestly okay with paying that myself at this point) that need sent to *********** in NC so that I can get credit for the power that the panels are producing. This paperwork has to come from the installer, per Duke and Sunnova. I have called literally dozens of times, with no response. I have left multiple voicemails with no response. I have emailed multiple times, and included the list of required paperwork directly from Duke so that I don't misrepresent what I am asking for. Again, no response. I have been dealing with this for several months (it is late October). Still, nothing from JW Bernard. All I want is to have them contact me and send the appropriate paperwork. That's all.     Bought a house with solar panels installed by this company. My electric company has no record of installation on file so the panels are currently useless. I've tried contacting by phone, two different emails, and left multiple voicemails with no response. I just need them to submit some information so that I can actually use our solar panels.

    I regret having to involve you in these emails, but we are at a loss for what to do next. We received a response from JW Bernard AFTER we had emailed leadership detailing the customer's experience with JW **********************, the installation team, and SunNova. Instead of using it as a building block, they responded with verbal retaliation and then removed us from the platform. We are now facing another potential cancellation due to a lack of communication from the installer about progress. We have several other deals pending and continue to receive calls from customers inquiring about updates from the installer.The number of cancellations we've experienced has been significantly detrimental and could potentially constitute tortious interference, a definite breach of contract, and a violation of SunNova's communication policy (refer to the screenshot below). Your website states that communication is key, yet months have passed without any updates on progress, and as of this morning, we have another customer looking to cancel.Furthermore, I have documented communications via text and email regarding ********** in **********, **. There was communication two weeks prior to signing a new lease, one week before, and then one week after signing the new lease, only to discover that the stores in ********** were not available. I signed a lease, rented out my house, and moved to ********** to work and develop the ********** locations.Regarding *************************: She has an installation on her roof, but the change order was overlooked, and the panels were installed on the incorrect side of the roof without any funds being disbursed.All we are asking is for the installer to provide updates to the customer, whom we brought to SunNova at our expense, only for them to experience no communication from the installer, leading to cancellations and our relocation to work in a ********** where JW Bernard does not have a contract.Our sole desire is to satisfy these customers.

    In response to the customer's complaint

    1. Fitz solar was removed from the Sunova platform after multiple times of being non-compliant with respect to chain of command policies. They have done this on multiple occasions and were informed that contining to violate the policies will result in consequences and termination. 

    2. There were several deals pending that we have not received the proper documentation to move foward with the installation process. There were maybe 2 deals that were ready to install that we did not have an installation date as of yet to complete, however the projects were still within the contracted limit to schedule installation. JWB could of keep more frequent communication here on these projects. 

    3. There was no confirmation given to Fitz Solar to occupy any of the ********** stores. There was a list given of availble stores that they can request so JWB can submit to secure the stores but there was never any confirmation given that we offically had these stores and no Notice to procceed was given to Fitz Solar to occupy the **********, SC Stores. There was a miscommunication here on the process to occupy the store. JWB should of set clear expectations on next steps that would of prevented this situation.

    4. ************************* chnage order was never overlooked. It is the seller responsability to make sure that all documents and change orders are processed prior to installation. However we are still communicating with Fitz Solar and the customer to complete the installation of this project prior to 7/31/2024. An email respond was sent to FiTz to give an update in the installation. Once the installation is complete, funds will be dispursed for this project and funds will be distributed to Fitz Solar.

    The Oustanding amount owed to fitz Solar for outstanding projects is Approximately $7500 not $75,000
