On April 11, 2023 my personal seat license to the ************** were sold on PSL Source. I was told the transaction would take about 3 weeks and upon the transfer of the seats I would be paid immediately..On April 17, 2023 ************ contacted me to say I needed to pay for the season tickets before the transfer could take place. He informed me I would be reimbursed immediately once the transfer was final. On May 10, 2023 the transfer was complete. Once the transfer was complete, ************ would not respond to my emails about payment being sent to me or would respond a few days later. To this day I still have not been paid for the sell of my PSL and I haven't been reimbursed for the season tickets. PSL Source misrepresnted and breeched our contract on the terms of recieving payment and reimbursement. Therefore, I am requesting the full amount of the sell of my Personal Seat License, $12000.00 minus the remaining balance of $4407 due to the **************. I feel that the 10% commision is not warranted to PSL Source due to breach of contract.

As a security measure, by default we send payment to the address on file for the Seat License account. The address provided by the customer was incorrect or out of date. The initial payment was sent ** mail to the old address, so there was an obvious delay as we waited for the customer to not receive the check, double check the address, and determine new checks needed to be sent out to the updated address that the customer provided to ** on 5/24. Those replacement checks were sent out on 5/25 via 2 day ****** Tracking #************. With the holiday on Monday, those replacement checks are scheduled to arrive on Tuesday, 5/30.

I am rejecting this response because:
It does not state anywhere in the contract that the check would be mailed to.the address the ******************** has on file. My account with ********************** has my mailing address.  ************ is lazy and unresponsive when it comes to communicating and emails. It would take him a week before responding once the contract was signed. I dare to see in writing about these so called POLICIES that you continue to make up as we go. It's only your word and nothing in fact written in policy or contract. ************ also waited an additional 2 days before sending anything out via ****** It wasn't overnighted. He purposely waited 2 days then sent it 2 day delivery intentionally delaying delivery out of spite. Apparently he does this to his clients and I'm not the only one. His lack of professionalism and breach of contract has caused me financial hardship. I have EVERY intention of pursuing this matter with both the ** office and small claims court if this is what it takes to receive the $1200 in commissions he took. All would be good if he would have arose above his pompous attitude and made things right. Instead he violates his own written contract and doesn't take extra steps in confirming mailing addresses. He also has violate the Fair Trade Act. Therefore,  I think he should forego the commission.

We received the updated address on the afternoon of 5/24. We cancelled the original checks with the bank (at our expense) and re-issued new checks to the updated address on 5/25 via 2 day ***** (at our expense). No request for or reference to overnight ***** was ever made. There was no delay on the re-issuing of new checks to the updated address, much less any intent to delay.

I am rejecting this response because:
************ is again being dishonest about what happened. I included pictures of my address listed on my profile with PSL Source. I included emails with dates about me asking him for tracking. I included the email asking him to overnight the check and the response with tracking info. I included the tracking history that shows the package wasn't even received by ***** until Thursday after hours which postponed the delivery for 5 days. ************ was aware of my mailing address had he went off the info I provided to PSL Source. Instead he took the address from a third party. I will be filing a claim for damages in a small.claims court for the maximum amount allowed of $10k. We can solve this issue and his lack of better judgements now with a refund of the $1200 fee. The fee is not warranted under his breach of contract. I am not going away and do not appreciate being taken advantage of and disregards.

I am happy to see that payment was received and cleared from our account today. There was certainly some miscommunication regarding the address to which payment was to be sent, which did result in delays in the customer receiving payment. Those delays were largely out of our control and there was never a delay in issuing the customers payment which I did personally in a timely manner. We regret if the customer remains unsatisfied, but have committed no breach and at no point intentionally delayed remitting payment to the customer as contracted.
