      On April 3rd my Car was towed by C&M towing and recovery. A good friend of mine is making payments to me on the 2008 ***** 6. Anyway, she had FTAs for driving charges and they took her to jail couple hours. Let me start off by quoting 14B NCAC 07A ***** ROTATION WRECKER SERVICE REGULATIONS. (10) The wrecker service, when responding to rotation wrecker calls, shall charge reasonable fees for services rendered. Towing, storage, and related fees charged for rotation services may not exceed the wrecker service's charges for nonrotation service calls that provide the same service, labor, and conditions. And that's just scraping the surface. I could go on about what the officer told me I should be charged, and how the owner was gonna let someone pay a cheaper fee and take the car without questions. Or how they tried to make the driver look like an Ignorant criminal. but I'm asking one more time before i take this to court ..... if my vehicle is such an Inconvenience to them so they say, then they should have no problem charging me a reasonable price for towing my car. C&M towing charges 65 dollars to simply tow a vehicle. To charge me $275 is ridiculously unreasonable and against NCAC.

      we have received at least six or more calls in reference to this vehicle from male callers and a female caller, we are unable to verify who the legal owner is over the phone. We have not given permission to anyone to come and pick up the vehicle unless they have a valid state issued id or driver's license, the title and proof of insurance if they are driving the car from our lot.

      Sgt ***** of the ** Highway Patrol in Haywood county ** approved our price list, his approval means that is the amount that a wrecker service is allowed to charge for their rotation calls, the city and county police go by whatever price is approved by the ****** I have two trucks that are approved by the ***** rotation inspector and two other trucks that are not on the rotation list.

      The trucks on rotation are required to have a minimum of  $2,000,000.00 liability coverage and those vehicles also are required to carry extra equipment that is not required for non-police rotation service trucks. We are also required to have coverage for all vehicles that are stored in our lot and high coverage to take care of anything else that *** happen while towing a vehicle for the state, county, town or city police calls. Therefore the cost to operate and maintain the approved trucks on rotation are much higher than the non rotation approved trucks and that does not include what it costs to maintain the trucks. We also have to turn down some towing calls while taking care of the police rotation calls which causes us to lose out on financial opportunities. All of these factors are taken into consideration when prices are set. 

      Our drivers that are approved by the state, town, city and county police are on call 24 hours a day and seven days a week. They are expected to drop whatever they are doing 24 hours a day to respond to these calls whenever they come in. These are just a few reasons for the costs of the rotation calls. I am attaching a copy of the price list that is approved by Sgt ***** of the ******************** Highway Patrol, the prices are set to cover the time of the drivers, the insurance and maintenance of the approved trucks. 

      This is a standard for all towing companies but since this individual feels that there should be an exception for them we will as a one time courtesy to show good faith reduce the towing fee for the ***** 6 vin# ending in *****, to $65.00. There is the matter of storage which in the *********** the standard rate is $45.00 per day and all vehicles that are stored in our lot incur this fee whether it is a rotation call or non rotation call. 

      This fee is charged the same to all individuals, insurance companies and finance companies that we store vehicles for and there have not been any issues with payment with any of the individuals that we have done business with. This is a business and can not do this service for free or we would not be able to stay in business and provide these services for the police and our community.

      I'm not sure where trying to make anyone look like an ignorant criminal came from, we dont know the individual who was driving the vehicle and what people do in their life is none of our business. All that we know is that the police officer advised that the driver was arrested as there was an outstanding warrant which is why we were called, all of which is public information.

      All that we need is for the registered owner to bring their valid state issued id or driver's license, the title which has to match the driver's license, proof of insurance if they are going to drive it from our lot and pay the bill. All of this is standard requirements by **************. We do not ever allow anyone to pick up a vehicle that does not show legal ownership as we are liable if it is released to the wrong individual. We do not have any interest in keeping the vehicle as it costs us money to process it through the system to be able to get rid of it so we prefer that people come and get their vehicles.

      The car has been in our lot since April 3, 2023 and storage fee started on April 4, 2023 which as of today (April 26, 2023) is 23 days and will continue to incur fees until paid in full and picked up at $45.00/ day. 

      Thank you so much for your time to help get this issue resolved in a more than fair manner. I don't know of any other company that would reduce their fees due to a complaint, however we will reduce the towing fee this one time to show that we are a fair company and that we are not trying to take anything from anyone.
