    On Friday March 8 I went to the ABC Mattress Discounters on *************************, **. I spoke with the Salesman- ******************* about buying a Queen size Mattress. I told him that I have a bad back with 16 titanium screws in my back- neck and body. I needed a good supportive mattress. I had a foam mattress and over time it sags around the edges and in the center. I wanted a Hybrid mattress which would prevent sagging and last longer plus the foam top would match my back. He showed me 3 beds to choose from and only one I thought might work. But I told him that I needed to make sure it would work for my back, He said not to worry it comes with a 10 year warranty. So I selected the Sealy- ********************* Silentnight Mattress. He told me that they would deliver the bed 3/12/24 between 12-2:00 and take my old queen size foam mattress away for no charge. I told him again that I have a very bad back and wanted to make sure if I had any issues I could return the bed. He said no problem. **** and his assistant came and delivered the mattress and removed the old one. After just one night's sleep I was in too much pain to sleep on the mattress ever again. I called to try to get *** Mattress and ******************* to pick up the bed and get my $850 refunded. **** refused and said that by NC law he can not take a bed back even if it was just used for one night. I said ******** and many Mattress dealers offer 90 day to 1 year returns if not satisfied. He still refused saying NC law prevents it. Once I involved my bank and dispute the purchase and contacted the ****** ***************************. **** called and said the owner would repay my $850 and that he would collect the bed. The Mattress was picked up on 3/28/24 and I have a receipt for the picked up Mattress- but as of today I still have not gotten the $850 refund to my Bank by the owner of *** Discount Mattress. If the merchant has gotten back the mattress how can they charge me for a product that I never got?
