    On June 14, 2022, I entered into a written contract to landscape my back yard at ****************. The contract terms also included an initial deposit of 50% of the total contract price, or ten thousand ninety three dollars and thirty two cents ($10,093.32). The check in the amount of $10,093.32, cleared my bank on June 16, 2023. It was understood at the time the contract was signed and deposit was tendered, work would begin in early fall 2022. An email in September ******************************************************** October 2022, delay in markings, restated to begin last of October. Emailed in November of 2022, having heard nothing, Emailed again December 2022, to which company responded; "I completely understand your email. I do apologize. There were some delays with markings and other items on our end. Your project is next. We are down to a two man team currently. Which is not your fault or problem but it has significantly slowed us down. We are currently working on fixing this problem. I sincerely do apologize it has been extremely hard to keep up with our current inbox and work load at the same time. As soon as this project is completed we will be starting yours. The current time line has us completing everything over these next three weeks. If anything changes I will personally let you know. This is now April 2023, no further communication, status, or response from the company, but ********* NextDoor Neighbor App, and website, show him working, and accepting NEW jobs. I have yet to receive communication or return of my deposit.

    Company has failed to complete project with committed delivery date in June 2022. Held several conversations with company, owner has committed to several deliverable dates to complete the project that have all been missed. Company has consistently lowered volume of communication and is rarely responsive as of 1/11/2023. Contract has been paid in full since September 2022.
