Started from late May, 2024, I reached a verbal agreement with the bussness owner for a fence installation project. I shall cover the material cost based on phurchase receipts and the labor cost for four people 10 days labor at $40/hr and the labor cost hard capped at $13000. The payment for labor is supposed to be paid when the project is completed. I have already paid for the major material purchses and $9000 out of the $13000 total labor so far. Now, the ********* keeps demanding for full payment without correcting/fixing the unreasonable/unacceptable problems, one of the problems is dangerous.

I am rejecting this response because: Part the job/work promised by the contractor was never completed and has been abandoned for months so far. I have the texting communication records to support the case.

I am seeking your assistance to mediate a disagreement between the contractor I hired to place a fence around my property and myself, the property owner. This is a verbal agreement starting in May of 2024, and our dispute has been ongoing for several months. The contractor agreed to place a fence around my property, which he has not completed. He demanded full payment for the project without completing it so I sought the advice of a lawyer who attempted to mediate. The contractor then agreed to finish the remaining work, and I agreed to pay the remaining balance upon completion of the project. The project remains incomplete and the work he has done thus far is of unacceptable quality. The contractor has indicated that he is aware of the remaining issues and agrees to fix them. I do not dispute the amount paid or the amount owed. The ongoing issue is that the contractor continues to demand payment for this work which remains both incomplete and of unacceptable quality. I have copied and pasted his most recent text message, which was sent to me on 9/20/2024. In this message, he indicated that he would fix the quality issues and complete his work the following week and he has still not made any meaningful effort to do so, over two months later. I have not received any updates from him since that time. I am only asking that he complete the agreed-upon work correctly, at an acceptable quality, and in a timely manner. I hope this can be resolved out of court. Please let me know if any additional information is needed. My mobile number is ************* and my email is ********************** Thank you very much for your assistance.

The following is the text message from the contractor on September 20, 2024

Bottom line is if you want its job done you put the string where you want it and I read nailed the boards I will cover the holes for the post and straighten out the gates and only because you owe me money but you know good as well that I did not do this job so you be honest and get me off that Better Business Bureau remark cuz I did not do this job and you know this but I have been trying my best to help you quit making changes and quit adding c*** I need this job done I need my money this is not anything to do with me I'm digging out my pocket helping you do a cheap job as you requested that somebody else you hired to do because you knew my price was $19,000 plus material as the paper says but I need my money that I'm invested now to try to make you happy the other workers walked off the job because of you and your changes I need my money I have did more than expected if you would have just leveled the land as I told you after the clearing of all the ***** this issue would not happen and if you were not have moved the fence and added 120 more feet to the fence them guys probably would still be there and finish the job but your changes cause issues and you know this but still you owe me money put the line where you want it and I will come and fix it just because now I'm got money invested

No I was mad yesterday when I heard about this and it still upsets me yes I'm going to finish this job I want you to put the string where you want it back there and that's where the top of the boards are going to go and eat still I'm going to need you to sign off we are not doing any more changes I'm going to fix the gates feel the holes and raise the board in the back like you said and straighten out the two by fours and cut off them two 2x6s and that should be more inefficient for the condition that the grounds was in we have done more than expected from anyone if you would have just listened at the beginning and level the ground before we started none of this would be happening but yes I'm going to finish it like I always do I stick by my word but you know as I know I was not the one that built that fence I am fixing it to help you out yes I learned a ****** if I don't do a job it
doesn't get done through me at all. I will never ever help anybody else out again when I give a price for now on that is what it is see you next week

I am rejecting this response because:

Sorry, I forgot to submit some text messages, payments, and photos records through the BBB website this afternoon. Please see the attached. The labor cost was already paid $9000 out of the hard capped total of $13000. The figure of $19000 in contractors last response was incorrect - that was his estimate but we agreed on the price of $13000. In addition, his accusations about me refusing to sign a contract and attempting to change the project are completely unfounded. Thank you!
