    Recurrent mold issue in apartment, affecting health and wellness of tenants. When brought to attention of property management was told to spray bleach on it to clean it. This does not solve mold contamination of porous surfaces. Issue has ruined property of tenants. Separate issue regarding safety concern due to improperly installed disability equipment in disabled apartment, occupied by disabled resident (myself). When brought to attention of property management only a temporary fix was performed and unit remains unsafe and inaccessible.

    I moved out of Wainwright Properties on September 30th, 2022. In an phone call I received from Wainwright, I was told that I was due $510, which is the sum of my security deposit. On that same phone call I provided Wainwright with an address they could send the check to. I also provided the forwarding address on my notice to vacate on August 31st. I was told that the check was mailed out on October 6th, 2022 by ***** at Wainwright. It has been more than a month, and I have not received the check in the mail. I asked Wainwright if they could issue a stop payment and re-issue the check. They said they could, but it would cost ME the stop payment fee of $35. I'm confused because this is not my mistake. Wainwright said that I could wait 90 days to six months before they can issue a stop payment and it wouldn't cost me, as long as the original check makes it back to them. I don't think I should be charged a stop payment fee for a check I didn't write. Wainwright's reasoning for charging me for the stop payment is they fell they've "...done everything" they were supposed to--which is true. However, I should not be penalized for a stop payment fee on a check I did not write. A check that never arrived at the intended recipient's address is between the sender and the United States Postal Service. I'm requesting that Wainwright re-issue another check for the full amount of my security deposit.

    ****** ******** contacted Wainright Property Management, LLC regarding his security deposit refund on Friday 11/11/2022 and spoke with ********. ******** was not the bookkeeper for the account responsible for refunding Mr. ********'s security deposit. She took a message and indicated the bookkeeper was out of the office and would return the following week and contact him regarding his refund. The message was relayed to the bookkeeper ***** that the refund check was never received. Mr. ******** came in the office on the afternoon of Monday 11/14/2022 after not receiving a return phone call quickly enough from *****. Upon speaking with Mr. ********, ***** indicated that she would have to research the check to ensure the check had not cleared the account prior to reissuing the check. ***** indicated that she would have to speak with a supervisor before reissuing the check and there MIGHT be stop payment fees charged to a tenant when reissuing a check; which is standard language used prior to researching any check. This is the conversation ***** indicated she had with Mr. ******** prior to researching the check - standard practice is NOT to charge a tenant the stop payment fee if more than 30 days has passed and the check has not cleared; but we must be given a reasonable amount of time to contact the bank/research a check before we can indicate if a tenant will or will not be charged. Regarding Mr. ********'s statement, we would never tell a tenant they have to wait 6 months for a security deposit refund. Neither Wainright Property Management, LLC or the tenant is responsible for the US Postal Service but we can only do our due diligence by waiting 30 days to allow the check time to return to our office if an address error was made - either by us or the tenant.

    This situation was quickly resolved once we were allowed reasonable time to research the check with our bank. We found that it had been more than 30 days since the original check had been issued and the original check had not cleared. The bookkeeper reissued the check on 11/15/2022 and contacted Mr. ******** to pick up the replacement check. At the time of this response on 11/17/2022 Mr. ******** has already picked up the replacement check. It is unfortunate that he felt it necessary to make a complaint against Wainright Property Management, LLC rather than allow us the required time necessary to do our job, let alone the courtesy!  We remain polite, calm and helpful to every tenant no matter how irrational and impatient. Thank you for your time.
