      Connor & Company, Inc. was hired to be responsible for preparing and filing all 2022 taxes for Biscuit LLC. Biscuit LLC was, at the time, a North Carolina based business that also received income from work completed in the state of ********. We requested an extension to be filed for all of our taxes, which we were given confirmation of (in writing) on 3/13/2023. New York State claims never to have received an extension for Biscuit LLC, hence the NOTICE AND DEMAND for Payment of Tax Due. The taxes for Biscuit LLC were payed before the extension deadline which leads us to conclude that the $500 fine we are facing is due to an improperly filed extension; New York State claims to never have received an extension for Biscuit LLC.

       I am rejecting this response because:

      The "unpaid invoice" mentioned in Connor and ***'s response is dated 12/5/2023, a time after we had ceased to be clients of Connor and *** Please also note that this date is after we had begun asking for proof of filing of extension form IT-370PF. There is no record of this invoice in our email, which is where all other invoices from Connor and *** were received. We request proof of when this invoice was actually sent to us as we have no copy of it in our records. Further, this response fails to address our complaint; there is no mention of if Connor and *** actually managed to file this extension on our behalf. We must reiterate that Connor and *** agreed to responsibility to file on our behalf while we were their clients.

      As we have stated before, the extension for the 2022 New York tax return for Biscuit LLC was submitted on a timely basis via the US postal service by regular mail.  This is a legal way to file an extension and we are not required to show proof of receipt.  Unfortunately, in this case, the state of ******** is saying they did not receive the extension according to Biscuit, LLC , but it does not prove we did not send it in on Biscuit, LLC's behalf.  Furthermore, we also filed the federal extension on behalf of Biscuit, LLC and it is not an issue.  If was filed, the exact same way by US postal service via regular mail.  I believe the conclusion to draw is NOT that Connor & Company did not file the extension but that the State of New York lost it in their processing or it was lost by the post office.
