Said incident occurred on Monday March 10, 2025 when a ***resentative of Farmington Wrecker service traveled from ********** ** to a private neighborhood and onto a private road and attached equipment to my personal vehicle ( 2014 **** Edge) legally parked on said private road ( ******************, Clemmons, ** ) and began to pull said vehicle onto the roll back tow truck. Upon confrontation the ***resentative of the tow company said they had order from the police to tow the vehicle but when told the police/sheriff has no jurisdiction or authority on a private road to have a vehicle legally parked the ***resentative was asked to produce an order from the police/sheriff authorizing the tow and could not. at this point i Called the sheriff's department and demanded a deputy to come on scene while arguing with the ***resentative to drop my vehicle yet he continued to load my vehicle onto the wrecker and began to attempt to hook it up to the flat bed at which time i made efforts to take the chains away from the *** of the company and he raised the hook of the chain in an aggressive manner and threatened me with words and action of raising the hook as if to hit me with it. This action and the resulting charge to " drop " my vehicle is a result of an on going criminal court prosecution and civil court lawsuit of a neighbor who owns and operates a used car dealer business in **********. While attempting to try to leave with my vehicle I stood in front of the tow truck and the driver proceeded to hit me with the vehicle. This all led to my arrest and later release with no charges however during the course of my arrest and transportation to the magistrate my wife was forced to pay $265 " drop fee" by the company, provided no receipt and resulting in damages to my vehicles front end from having been dragged from its parking spot and onto the truck. Business Response

I am the owner of Farmington, ****** ********. I am aware of this incident and I was on the phone with my driver as ******* threatened to harm him by pulling him out of the truck and threatening to beat him. His neighbor had called the ******************** because ********* car was blocking his driveway and he had refused to move it. They instructed him to have a towing company come out and move it. I believe the simple fact he was arrested, not my driver, speaks volumes. We will not be reimbursing anything. Thank you and have a nice day.

I am rejecting this response because:

    *******,

Thank you for your response and the copy of the owners reply.

Everything the owner said is an absolute and outright lie.

The sheriffs office was called out early in the am by a neighbor who there is an ongoing property dispute and who has been charged, AND found guilty, of criminal trespass and criminal damage to property. Said neighbor has continued to wage an ongoing acts of retaliation and harassment by various means and this incident was only another one of his antics.

The deputy informed the property owner that in fact he was not blocked in and my car was parked on the street and not in his way to prevent him from pulling out of his driveway way.

The neighbor , according to the deputy, asked about towing the vehicle  and was told there was no need and it was a private street in a private neighborhood and they had no jurisdiction. The deputy said he asked if he can tow it on his own and told him it was a civil matter and he couldnt tell him what he could or couldnt do but he could get his car out( which was the original call to the sheriff office).

As far as threatening the tow truck driver I freely and readily admit it after he physically hit me with the tow truck twice and after his driver raised a tow hook on a heavy chain and made a gesture to swing it at me to cause me injury and harm.

My arrest had nothing to do with the tow truck driver at all or the towing incident.

It was because I told the Lieutenant ,who I requested come on scene, he was a lazy fat a** for not doing his job, threatened to call Sheriff ********* and how it was BS they supposedly couldnt do anything on private neighborhood when his own deputys testimony said my vehicle was parked so as not block the driveway.

Upon appearing before a magistrate the charge was interference and the magistrate would not proceed with charges on grounds of no probable cause for the arrest at all and I was immediately released with an apology. All of this is on legal record, what record does the defendant, the tow company have? Nothing but lies. Witnesses? None yet I have witnesses who will show the tow driver was the initial aggressor.

My understanding is the BBB is there for consumers and to be a symbol of reputable businesses.why didnt sheriff calls tow company? Why was a tow company 30 miles away used? Because the neighbor, convicted , seeks retaliation.

Please let me know what is next and what I need to do .

    Respectfully,

    ******* W *****
