    Agreed with estimate and paid Modern Irrigation and Aquatic Solutions LLC 1/2 of estimate on 2/05/2025. System has been put in and functional with a few minor adjustments that still needs to be done on start up.The county however rejected/locked out the system so it can not be used till the backflow is installed above ground. I paid the installer in full for a job that i thought was complete on 3/12/2025. To this day 4/9/2025 I can not use my irrigation due to it is locked out. I texted installer on 4/08/2025 and said he would come the next day and move it. Well it was a no show again. I just want what I paid for up and running like it should. In February the estimate states a 2-3 day job and here it is April. Too many excuses. Won't call back, won't acknowledge text. I don't know what else I can do. I.

     I am rejecting this response because:  

     I have tried via text to get Modern Irrigation And Aquatics LLC out to my home to finish this job he has started in February 2025. I keep getting excuse after excuse. To this day the project has not been finished and I feel he has abandoned the project. Also this business does not have a license to do **********************.

    On May 11, 2024, Modern Irrigation and Aquatic Solutions responded to an ad I placed through Yelp for someone to maintain my swimming pool for the summer. After our first visit for which I paid $170, we agreed that they would take on my job. I paid them up front $482. 32 for the first month of service. A week later they informed me that because of the complexity of my pool, they were not going to be able to provide the service for me. I asked that they refund my $482.32. They said I would get my refund within 7 to 10 business days. Not receiving my refund as promised, I had to call the company several times and spoke with ****** who assured me that the company who handles their refunding work would get the refund to me. After another call ****** informed me that the refund problem was out of her hands as the company she uses is responsible for getting the refund to me. I told her that she was responsible for getting the refund to me. After several calls with promises that the issue would be looked into, and no resolution in site, I proceeded with this complaint to the BBB. The refund was promisesed to me 7 to 10 working days from May 29th. As of today, June 21, 2024, I have not yet received the refund

    ****************** is not being honest about the situation. Her pool was damaged due to tree falling in it. We did go out and did a diagnostic on her jets and system.  However her water was u set the skimmer. It needs to be at least half way above skimmer to work properly. We told her the concrete could have a crack however the pool was full of leaves and looked like pea soup. You had zero visibility. We stayed many hours waiting for pool to get above middle of skimmer. Ran her system etc and told her if water lowered below the skimmer we could not treat the algae since the pump needs to be running. She said she will get someone to come and clean pool by hand and see if any cracks. She then signed into a monthly contract and paid. She then said nobody would be able to clean it by hand and she felt it was our fault it had a leak all. When she had a huge tree fall across it and you can see how crooked it was now. She said I do not want maintenance to start until she fixes. And said she was going to report us about her own leak to the bbb. She said that in text in second conversation we had. She then decided not to fix the pool and asked for a refund. We told her it was no fault of ours that we could not do her maintenance as contracted and she still owed since I had put her on the schedule and moved it several times. Taking spots I could have put others. So she was due no refund. However, you should know she did get her refund. Her credit card company took the money back from our account and never contacted us to see what the story was. ****************** claimed from day one and almost every conversation that shes been screwed over many times and has no problem reporting to bbb and yelp which she did. I have attached invoice in which she read and agreed to and paid. But regardless she got her refund back. Just wish people were more honest these days and didnt want to s**** over contractors.

     I am rejecting this response because:

    This reply is total fabrication.  I have invoices which describe what they did and the cost.  I will forward these invoices which describe what they did and what future plans they had to do together with text messages which were extensive that tell the true story of what happened with this company.  They are the ones that decided not to do the work to the pool because it was a complex project.  I thereafter hired another pool company who got the pool going, cleaned my pool in 3 visits, and maintains it now and it looks fabulous.  

    My credit card company HAS NOT taken money from their account, that is absolutely not true.    My credit card company is still investigating this matter for me.  Once they are finished investigating, if my money is not refunded to me, I will take this matter to court.

    This company is saying that I have received my refund.  I have checked my credit card statement from the day I paid them and see no transaction that shows a refund.  I tried for over 20 business days to get this refund and received all kinds of excuses including that the company they use for refunds are investigating where the refund may be.  

     

    My credit card company gives me a deposit for the amount I am disputing until they thoroughly investigate this problem. They have not yet resolved the problem with this company.

    I would to close this complaint.  The complaint has been resolved.  *********** refunded me my money and I am satisfied with the resolution.  It is unfortunate that it came to this and am happy now that I won't have to have a conflict with this company.
