    Chief complaint is that ******* Fine Homes installed a fireplace which poses a fire risk to our new home. The system is not vented, does not have a blower, no mantel and has a large wall space above the fireplace in which occupants commonly install a TV or add large pictures/paintings. The heat put off from the fireplace is significant enough that the TV brackets, when the TV is pulled out away from the wall even, got too hot to even touch. If the TV were not pulled out and left against the wall it would likely melt the TV or any pictures placed above it. It poses a huge fire risk that Colmen is not willing to resolve and if something were to happen, they will end up in court with me for sure. While the mantel has been a topic of discussion, and they provided a wood mantel as their only resolve (not installed), I'm afraid it would catch fire as well. At one point they offered to put in a concreate mantel, but that was then rescinded. They are asking me to take on a huge liability and putting the safety of my family at risk. I find this unacceptable. This is not mentioning other issues that we had during the move in with propane tank not being installed or the ground leveled around it. We were also paid less than was what discussed for a lease back option. The superintendent (******) has been great and apologetic that ***** ******* is not willing to resolve these issues. We still have several punch list items to be resolved like windows, but I'm trustful that ****** will get them addressed for us. Just be sure everything is in writing because a word and handshake mean nothing to Colmen.

    finished .they refused to put in the above shelves, stating that wasn't in the contract and they refused to have the work completed even if we paid for it. They also refused to give me a name of someone to finish. Never ever once does the owner have the courtesy to return any calls or emails. The whole building process had been j6st horrible..time and time agsin they did want they wanted to do..ignoring our requests time and time again.

    Business Response /* (1000, 15, 2023/01/03) */ The pantry shelves that were mentioned and requested were not contractually obligated items, nor were they on the initial plans. We did not want to perform the work ourselves or recommend any of our valued trades as we did not wish to subject anyone to the type of behavior that the Nelson's exhibit. We have reached out numerous times in an attempt to complete warranty work and punch list items. The homeowners do not live in the home and the current tenants do not enjoy having people at their house so we were not permitted to conduct the work. We are happy to conduct the work at a time that is suitable to all parties involved.
