    I signed a 90 day contract with Summit Construction and Hardscape back in 10/15/2022 to have a bathroom installed in my basement and a separate wall put in in another part of the basement for $13,400.00. I paid them $6,700 up front for materials and the project was to start a month after signing giving them time to purchase materials. A month came and went and I had to contact them on several occasions asking when the project was going to start. I'd get a response saying something came up on another job or inclement weather would impede the process. In mid December, construction finally started with the basement wall, then another month went by with no work done. Upon inspecting the work that had been done, to the wall, I noticed that the plywood placed on the wall was able to bend in certain area and that the studs in the wall were placed 40 inches ( standard length should be 14.5" or 16" ) apart and no bottom planks were added to the wall as well. After several calls and no answers from Summit, 90 days had come and gone and I was forced to try and terminate the contract, but my calls were never answered, so I took to the BBB and filed a complaint. Less that 24 hours of my first complaint being posted, I received and email from Jake/L**** stating that I would get my remaining money back from them soon minus the cost of materials and that was on January 25, 2023. I added up the cost of materials that were left in my basement and they totaled around $400. Jake was at the house for about 10 hours putting up the wall. I mailed a contract termination notice to them in late January of 2023 and I have yet to receive a phone call or email from Summit stating when my refund would be sent to me. Jake/L**** lawyers will be involved if I have to file another complaint.

    We were more than willing to come to an agreement on settlement with this. However,  the morning ******* sent a “text” to me stating they would not like us to proceed I responded shortly after that same morning letting him know we need a formal breech of contract in order to do so. Not even a coupon of minutes after my response he had came to BBB and file a complaint. We were given no time at all to return any deposit or even receive a formal breech from them at this time to try and resolve anything.

    We are in the process now of reaching back out to ******* about resolving this issue.
