IN 2022, SOMEONE WORKING FOR WRIGHTSVILLE BEACH LANDSCAPING *****ED A DARK LIQUID ONTO MY HISTORIC ****, PERMANENTLY DISCOLORING IT. AFTER SEVERAL FAILED ATTEMPTS BY THE LANDSCAPE COMPANY TO USE CHEMICALS TO REMOVE THE ***** STAINS, A REPRESENTATIVE FROM ** LANDSCAPING TOLD ME THAT THE COMPANY WOULD HAVE THE **** PAINTED. LITTLE DID I KNOW THAT THE WORKER WOULD COME ***** PAINT THE ****, WHICH MADE IT LOOK WORSE TO ME. TODAY FEB 23, 2023, I RECEIVED AN EMAIL FROM THE ***** OF THE COMPANY TERMINATING MY CONTRACT WITHOUT GIVING A REASON, OR WITHOUT ANY COMPENSATION OR PROMISE OF REPAIRING AND PAINTING THE DAMAGE HER WORKER DID TO MY ****.

I am rejecting this response because:

I am not wholly accepting this response because this historic wall issue has been ongoing since the first bill, as uploaded here, for almost a year since the first iron spray in March 2022. After many failed attempts by ** Landscaping to remove the stains, I did spray a product over the damage they caused, at least 6 months later because it looked horrible and they were not resolving the problem. Then, the company sent someone back to spray the same product over more of the wall. It looks horrible. I had sent the product information to ***********************, my landscape manager, to have someone properly roll the product over the wall so it looked uniform. ***** told me 'they were not painters, and to get bids to properly repair, prepare and paint the wall.' The spray is also on the neighbor's wall, but the company seems to 'disregard' that damage for some reason? What about the damage you caused them? Also, I had a contract with *********************** to plant a 'green wall' after spending many thousands of dollars to prepare my yard, use many insecticides and much maintenance over this past year. What about this proposal that I accepted? Then, ***********************, decides to "not renew" my contract without a reason via an email that looks like a ****** letter, while I had already invested over $4,000 in her company. *********************** did not know about the contract decision to not be renewed, and we were planning to plant rose bushes as a green wall, and I thought we were ordering those bushes this month to proceed? I have been trying to get this wall stain issue resolved, and painted with the same product that has already been applied to it. I would accept that the company work with the contractor who is submitting a professional painting bid to repair the damage to ***********************, and pay him to have that done and move forward.

    Sincerely,

    ***********************

Wrightsville Beach Landscaping is 100% committed to finding a resolution to this matter. Since the damage was first documented in April of 2022, WBL has taken steps to try and rectify the situation. We agree with **************** that the stains on the bottom 12 to 14 of the wall were the direct result of our turf chemical application. We disagree with the statement that we are responsible for repairing the wall in its entirety, or that we have not taken any action before this complaint. In order to remedy the situation, we requested **************** receive a quote from a qualified professional to repair these damages. As of March 8th, 2023 we have not received any quotes. We tried several cleaning and stain removing products, all which were documented and communicated to ****************. WBL tried Iron Out, Muriatic acid, vinegar, and bleach:

    Hello,
We are returning again to try more iron removing products.

On June 14th, **************************** ************ to spray a rubber spray paint on the wall. Per the homeowners request we sprayed 2 cans of white **** Seal only on the areas we damaged. (see attached pic sent from ****************) This was only on the very bottom portion of the wall. (2 Pictures attached to show the areas WBL sprayed at her direction)

**************** accepted a landscape enhancement proposal from WBL in June of 2022. Due to labor shortages and scheduling backlogs the work was delayed by more than 6 weeks. In August of 2022 **************** sent an email to *********************** requesting the work be postponed until the Spring of 2023.  WBL is committed to fulfilling its current maintenance contract in entirety, but has decided to not renew for another 12 months. All contractual obligations have been met and will be completed as of March 31st 2023.

The three pictures attached are *************************** emailing *********************** a picture of **** Seal to use and email that went with photo. The third photo is after we applied the flex Seal to the bottom portion of the wall per *************************** instructions.

    Thank you,
    ***********************

    Complaint: ********

Hello, here is the estimate to fix the damage caused by the WB Landscaping company, after they sprayed, and then tried to scrub the permanently stained iron-colored product off of the historic wall, yet failed to remove it after several attempts over many months. The landscaping company may pay the contractor directly for the repair.

Also, if the landscaping company does not agree to pay for the repair work, then I am prepared to submit my claim to small claims court; including the fact that no one ever called me to discuss not honoring an annual contract I had with this company for yard service (which has been discontinued before my annual contract expired in the end of March 2023 despite the company stating my service would continue to the end of the month), or for a signed landscaping project contract signed in June 2022 for $3,401.55, scheduled to begin this spring 2023.

Despite the hardship ** Landscaping has caused me, and the permanent extensive damage they have caused to my property, and their unprofessionalism in upholding contracts, or in contacting me before canceling my contracts, I would like to move forward and have the company pay the contractor directly to do the repair work.

This is the only resolution I will accept. I have also filed a consumer complaint with the ************************, and have sent them this same information.
I can provide other documents, such as these signed contracts, and email correspondences that support my position.

    Thank you,
    ***********************

    Complaint # ********

WBL has received an estimate in the amount of $2370.50 to pressure wash and paint the entire wall. WBL is only responsible for the bottom 12 of the wall. It was at the direction of **************** that we applied a rubber flex seal paint on the very bottom portion of the wall. WBL did not apply paint to any other areas, only the bottom, and only after we were directed to do so by *****************
WBL has a 12 month landscape maintenance contract with **************** which will expire on 3/31/2023. WBL has and is fulfilling all contractual obligations until the contract expires. WBL provided **************** with more than 30 days advanced notice that we would not be renewing her maintenance contract for an additional 12 months.
Wrightsville Beach Landscaping is still committed to finding a resolution to this matter. We are willing to pay $1200.00 towards the repair of the wall. We feel this is more than satisfactory.

    Thank you,

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.

Please send the contractor who gave the estimate the check for $1200.

And you are incorrect, I have not had yard service for at least 2 weeks.

    Sincerely,
