I ordered furniture from store September 1, 2022. The purchase amount was ********. I ordered a 2 couches and 2 chairs. My order windows was 12 weeks.
I messaged owner February 7, 2022, wondering where my furniture was and how I had not heard from him. He told me my fabric was on back order. I asked to order the couches in another fabric. He told me he would get back to me on that in a week or so. I had not heard from him, and I stopped by another store and asked about my fabric. They said ****** had discontinued the fabric. I called the owner and told him the news. He told me he wasn’t not informed on this. I asked him to ask his representative. He didn’t hear back from him for 2 days. I reached out to him again and he still hadn’t communicated with his representative. I asked him to cancel my order. He confirmed two days later and told me that I would receive a full refund. It’s been 2 weeks now and I have not received my refund. He says he needs to talk to his accountant to issue my refund. I also called ****** furniture and they have no record of my order and when I ask him for my order number he’s never given it to me. I think he pocketed my money and no is not refunding me, or doesn’t have the money to.

Thank you for reaching out to me.

As you know, I've been in business for almost 9 years and have never had a customer complaint.

The customer placed a custom order for furniture and was not happy with the delays. She cancelled the order and, since then, we've entered in to a mutually agreed upon refund plan prepared by her attorney. I am sending a check for $**** every week - and a smaller amount for the final payment - until the refund is paid in full.

I believe this plan satisfactorily satisfies the complaint.

      Complaint: ********

I am rejecting this response because:

He has not showed proof nor provided proof of signing the promissory note prepared by my lawyer. The lawyer asked him to send it to me with my first payment and he did not. Although he did send payment, he isn’t following actions my lawyer requested of him. Without signing, I do not trust Tom to complete all payments to me.

      Sincerely,

      Nicole *********

I sent the original to the attorney on 17Mar23 as I felt it best the attorney administrate the contract I completed.

Ms. * emailed me that the attorney said their office hadn't received the signed contract so I reprinted and signed the contract and sent it to Ms. * with the second payment on 24Mar23.
