      -Peak Design Builders built our home
      -Closed on 9/11/2020
      -Submitted 1 year warranty list on 10/3/2021
      -No work done until March of 2022
      -The original project manager (Rick) didn't complete the work
      -Andy came to address and fix the rest (he didn't)
      -Sent us an email on 3/17/2022 stating some was done and some wasn't (most hadn't been)
      -No follow-up from Andy; we reached out again on 9/29/2022 (4 emails with no responses)
      -Andy sent Anthony out - he made the tub worse and installed the wrong kitchen drawer
      -Andy will not return calls, texts or emails at this point
      -Anthony keeps saying "contact Andy"

      Please note my response and all attached documents supporting my response to the warranty items addressed at **** ** **** with homeowners Shala and Kevin ********.

      A 45-Day warranty period was provided to the homeowners to address any issues right away for their new home. On October, 28th 2020 a list of items was provided to the builder (Peak Design Builders) for warranty (see attached ***** 45-Day Warranty list document). All items were addressed from this list.

      A 1-year warrant period was provided to homeowners per warranty requirements. On October 3rd, 2021 a warranty list was provided to the builder (see attached 1 year follow up list - Official List document). Items were addressed per national home builders warranty standards

      On March 17th 2022 an email response was sent to the homeowners regarding the last remaining items (see attached ***** 1-year warranty items Builders Response document).

      On March 20th 2022 homeowner, Kevin, responded to the official remaining items on the warranty list (attached 1-year warranty items Owners Response document). Please note Kevin's understanding and acknowledgement of the last items remaining as builder noted as stated in his email.

      The remaining items left were so minor that homeowners were very patient in waiting for them to be fixed. Homeowners had to remind the builder of the outstanding items per email sent previously March 17th, 2022 and acknowledged by Kevin ******** on March 20th respectively.



      On October 10th, 2022 Peak Design Builder's warranty tech, Anthony, scheduled to finish the items on warranty list per the email on March 17th 2022. The warranty tech told the builder that the homeowner, Kevin ********, was present on this day and spoke with the technician regarding remaining items. When the technician was done, Kevin shook Anthony's hand and told him "Thank you". Anthony notified the builder he was completed at this address. A written statement by the technician can be provided if deemed necessary.



      Peak Design Builders has fulfilled their warranty items per the documentations provided.

      None, of the remaining items that Andy agreed upon in his email have been fixed: hole in downspout, siding coming off, drawer (more on that), and the tub (more on that)



      Anthony did come out on 10/10 to work on items. He replaced the drawer with the wrong drawer. It is not a soft close like the original. When asked why he said, " You need to discuss this with andy. That is what i was given for your warranty repair." The tub is also worse as far as the noise goes. I showed Anthony the other items and he agreed they needed to be fixed.



      There is also the other work (agreed upon in the 1 year) that was "attempted" to be repaired but was not. This primarily includes the flooring in our master bedroom. The gutters out front and the master bath lights are also not working after having a tech look at them. Andy also verbally agreed to fix the flooring in the kitchen by the island.



      Andy has cut off communication as we tried to email, text and call as instructed by Anthony (warranty guy as Andy put it). Neither warranty tech told us things were not included -- they continued to say "reach out to Andy".



      We understand some things are not covered, but the items Andy identified in his email (listed above) and him verbally agreeing to fix the kitchen flooring are items that should be compensated for as they were included in the 1 year in a timely fashion.



      Last point: we did not consider the items to be "so minor" that we didn't reach out. I sent numerous emails with no response. Also, we respected Andy enough to understand that he was busy..



      I've attached the "completed" work that took over a year to "complete". Is this how you stand behind your work?
