Deceitful business practices. The associated who came to my property quoted a different amount then what was charged after the work was completed. Went directly to my insurance company for additions to the original work order. Never had my approval for the additional work. Now has filed a lien on my property using a false last day of service. Last day they were on my property working was November of 2023 and filed the lien on 6/14/24. Way more than 120 days from when they were last working or had materials on my property.

In regard to the client, the last day that we were on their property to performed work was on March 15, 2024, not in November of 2023 as stated. Secondly, the lien placed on the property is due to the remaining balance owed, which includes the deductible, and a final payment check that was sent by the insurance company on 11/02/2023 that we have not yet received as of the date of this message. We have documentation to prove that **** ***** was on the property on March 15, 2024, with the inspector that was hired by the mortgage company to carry out a final inspection.

If require further clarification, you can contact our lawyer that has all the documentation. If that is the route to take, please contact me and I will provide the information of our lawyer.

The work completed was based on the insurance paperwork provided, in accordance with the agreement signed. The agreement specifies that "all work will be completed according to insurance scope" which was done.

      Business Response

      Date: 08/09/2024

Response to Rejection: We understand what the customer is saying, it is true that one of our team members was on the property on March 15, 2024. Our team member did the final inspection by doing a physical walk-through inspection with the mortgage's inspector. Our team member physically showed the inspector what the mortgage was looking for in order to release the final payment so we could get paid for the work that Rafa Roofing did. The inspection consists of: The roof, the fascia, the siding, the metal roof, and the window screens. In this case, we have our lawyer involved and we have provided our lawyer proof of what we are saying is true. Once again, the homeowner owes their deductible and a check that the insurance has sent out, but we have yet to receive. By the state law, it is illegal to not charge the deductible.

By the BBB Complaint made by the customer, we have gotten our lawyer involved in the situation.

      Complaint: ********

I am rejecting this response because: The contractor does not have a right to file a lien because it was filed after the allowable period to file.  According to the law, the contractor has to perform work to improve the property to constitute the last day worked in filing the lien.  There was no work performed on my property in March 2024.  Walking around with an inspector is not work performed on my property.  In fact, I did not even authorize him to be on my property in March of 2024, so he would have also been trespassing.  Nothing was said about a deductible by the representative of the company nor have I said this.  The representative said that I would owe them whatever I received in payment from my insurance company.  This has been paid and now they are charging me more than what their rep told me when starting the repairs.  I truly believe they thought they could get by with this deceit because I am a single mother with no other means of support.  I am fighting back so that other women do not have to go through what I have went through with this company.  They are going to leave me homeless with their deceit and they absolutely do not care

      Sincerely,
