    I, *** ******** contracted with DVS Contracting, ****, the owner, to rebuild a retaining wall and construct new steps at my residence at ***** ******* **. Omaha NE.
    Without bargaining or negotiating with ****, I agreed to his bid of a two-part project of $5700.00. First part started on Oct 10th. Old retaining wall removed and paver wall installed first, done in a good appearing and quality install fashion, albeit pavers having smeared adhesive showing.
    The steps installed next, completed (Oct 15th) I have had a chance to utilize and take a look at poor appearance and workmanship of the steps, significant issues concerning safety, comfort and practical use.

    1. South facing wall of steps is at least 2” unlevel all along the top.
    2. The bottom step is 10” tall, which is too tall, very uncomfortable, trip hazard.
    3. The other steps are at least 8” tall, still too tall to walk comfortably. I believe safe step install normally does not exceed 7-3/4” height, Douglas County code?
    4. Each step has a varying “toe” overhang from none on one end to over 1" on the other end, again code and trip issue.
    5. Adhesive smear top block obviously visible and unsightly.
    6. Bid stated 5 to 7 steps, the steps are 4 high, with an after thought another step that doesn’t really follow grade.
    I contacted ****, the owner and installer on Monday, November 18th, sent pictures and expressed my concerns. We talked on the phone, him stating he would stop by and look soon, but made no commitment to correct anything. As of December 4th, he has not followed through with any contact or corrections to poor quality workmanship on the steps.
    DVR website shows pictures of new steps being installed and dedicates paragraphs stating commitment to quality work and customer satisfaction, it appears neither is true.
    I am deserved a refund of $1400.00 for the step install attempt or a tear out correcting steps, step height, toe overhang, step count adjusted to grade and a level outer wall.
