    On 12/13/2023, I purchased contact lenses from Omaha Primary Eye Care that were based on an incorrect prescription and were unusable. I am requesting a full refund of the purchase amount.

    The purchased contacts were from a comprehensive exam dating 11/13/2023.  Pt returned to the office with complaints of dryness on 12/5/2024.  We re-evaluated the pt and decided address other issues that seemed to be causing issues.  We did 1 treatment out of a 4 series treatment and then the pt did not return until 11/18/2024.  At that time the pt mentioned that he had still had been wearing the contacts 1-2x / week over the last 11 months.  

    We have refunded his exam from 2024, any products purchased at that time and the treatments, full refund, on the 4 series for all of 2024 after the pt went for a second opinion.  

    I feel that the pt would have come back to the office for either more treatments or at least looking for some resolution to the issues that he was having with the contacts from 2023 sooner than 11 months.  He was also wearing them 1-2 x per week over that time when he returned on 11/18/2024 for an annual exam.  Due to this lapse of time that pt allowed and that he states he was wearing the contacts, some but not full time, indicates that he did use the product that he is asking for with the refund.  

    I feel I have treated him to the best of my ability and looked out for his well being and due to him going for a second opinion due to maybe losing trust in my skills — we have been fair in giving him all his $$ spent in my office for the 2024 year.

    We have had numerous correspondence through emails and such from the person who filed this complaint--we have filled ALL the requests that he has made through electronic records and refunding the $$ that have been requested.  We are not going back to 2023 for medical product that he purchased and did not reach out to us in any timely manner to discuss what was not working--there was an 11 month difference before he made us aware of any concerns he had.  This refund is a request on product and there is a time frame that we adhere to from the manufacturer time line for refunds.

    Subject: Update to Complaint # ******** * Retaliatory Dismissal and Continued Unresponsiveness

    To Whom It May Concern:

    This letter provides an update to my previously filed complaint *********** against Omaha Primary Eye Care, located at **** * ***** **, Elkhorn, NE 68022. My original complaint concerned *** ****** ******** misdiagnosis of my vision conditions and resulting incorrect contact lenses.

    Since filing my original complaint, significant and concerning events have occurred:

    Retaliatory Dismissal: I, along with my spouse, Erin Fehderau, have been dismissed as patients from Omaha Primary Eye Care. The stated reason for my dismissal, as provided in a letter from **** ****** (CFO), was "aggressive and harassing emails and letters." I strongly dispute this characterization. My spouse's dismissal notice explicitly stated that her termination was due to "recent interactions with a family member," clearly referring to me and my legitimate requests for medical records and clarification of billing practices. I believe these dismissals were retaliatory actions in direct response to my complaints and my efforts to obtain my complete medical records.     Admission of Retaliation by CFO: In a subsequent email, **** ****** explicitly stated that my dismissal was based on my Google review, my complaint to the Better Business Bureau, and my emails requesting my records. This is a clear admission that my dismissal was a direct consequence of exercising my rights as a consumer and patient. (Attached: Email from **** ****** dated February 12, 2025)

    Continued Unresponsiveness and Refusal to Substantiate Accusations: I have requested that **** ****** provide specific documentation to support the claim of "aggressive and harassing" behavior. He has refused to do so. This refusal further reinforces my belief that the accusation is false and that the dismissal was retaliatory. (Attached: Email to **** ****** dated 2-17-2025 and 2-25-2025, demanding substantiation)

    I have also filed a complaint with the Nebraska Department of Health and Human Services, which has opened an investigation into this matter.

    These actions by Omaha Primary Eye Care represent a serious breach of professional ethics and demonstrate a pattern of retaliatory behavior and unresponsiveness to legitimate concerns.

    Desired Resolution:

    I am seeking the following resolution through the BBB:

    1. A formal retraction of the false and defamatory accusation that I engaged in "aggressive and harassing" behavior.

    2. An apology from Omaha Primary Eye Care for the retaliatory dismissals of both myself and my spouse.

    3. Full cooperation from Omaha Primary Eye Care with any BBB inquiries regarding this matter.

    4. A refund as originally requested, for the incorrect and unusable contact lenses.
