    Construction of project for home addition started in December several months after waiting on permits.

    The project is about $65k to add addition of the basement workout room and an office off of the dining room.

    The business owner - ***** ******** - claims the job is done but there is damage to property and work done on the house by his subcontractors that does not meet standards for warranty of the exterior siding that is now formally inspected by the siding manufacturer confirming void of warranty and prone to water damage of house.

    Regarding siding, we have multiple bids with some contractors not willing to try and fix the job, but requiring full redo of the work because of poor workmanship of *****'s subcontractor. The estimated replacement cost is $9k and we have been transparent with ***** about this but he ignores what we say and threatens to put a lien on the house and continues to try and intimidate us.

    We have $4726 held back from the final bill which was initially for the damage of blinds and other work waiting to be done. This is much less than the cost of replacement siding and replacement blinds.

    On the topic of blinds, his painters also got paint on blinds that ***** insisted on trying to fix sending them to ***** ******** and they made the damage worse. ***** now tries to deflect from this topic and says that the blinds were not up during painting of cabinets but we have proof that they were and have text of him acknowledging fault and he was willing to make right until he saw the replacement cost of $2.2k and his tone flips.

    ***** continues deflecting the topic and we have had multiple BBB accredited contractors come out to evaluate the work and they all see this as unacceptable. ***** refused to even come out and observe this until we told him that we ourselves contacted the national rep of the siding company filing a complaint that made their rep come to our house yesterday and did formal write up of issues voiding the warranty.

    This is an answer to ****** ******** Complaint;




    The siding bids from the contractors to homeowner, was not practical and they wanted $9,000.00




    We have met with the homeowners and **** with ******* ******, ****
    has met his foreman out with the homeowners to go over all the repairs
    that they want, before we start siding repairs.




    After the siding is okayed we will insulate the ceiling to meet Gretna permits and fill in the spots from the electrician.




    Midwest will also do repair work according to gretnas 6" minimum ground to siding.




    As far as the blinds, we had ***** ******** come out and clean the
    blinds, but it wasn't adequate for the homeowner, so we are working with
    their attorney to get it resolved.




    As far as "***** refusing to come out to the job" I've been out on
    their job 3 times a week since December 2023, and all the subcontractors
    who were working on the job will verify.




    As far as the blinds go there was one spot the size of a pencil
    head, and the other spot was the size of an eraser on a pencil, and you
    can only see it at night with your hand being behind it.




    Again we are working this out with their attorney.




    We tried to get Millard Lumber to contact the national rep for the
    siding company but they said they stopped using them shortly after we
    installed the siding that matched their house. Apparently they had
    problems and they stopped using the siding.




    We will send a copy of collins production national siding company
    that the letter states small problems, but they offered a good will
    gesture to fix the siding for $247.76 to help with the cost of repair.




    The panels that remain on the structure will retain the full warranty.

    1)I've been working with the attorney, **** ****n, daily. Maybe their attorney hasn't been relaying everything to the clients which I would have no knowledge of. So for the ******** to say that we haven't been working with them or their attorney, I have paperwork for the last month just corresponding with **** ****n about this job.

    2) I'm not sure what he means by this because we had a meeting last week and all the issues are going to be taken care of per the siding guy, and I'm not really sure where ** ******* is coming from here.

    3) Again, we just met last week and have a plan of action that the clients and the attorney know about. 

    4) I'm baffled again here because is he talking about the insulation company that we have given them their phone number to give them a call? Again, we met last week with the owner of ******* ******, so there is no way that there is any refusal of any contractor, and if he is talking about the insulation company we gave them a copy of what work was to be done, and I'm paying for it. They just need to contact the insulation company.

    Per the last response I just got done sending a long email to their attorney **** ****n, and I had a long conversation with her on the phone Monday, and she is trying to get things resolved, as am I.

    We are trying to do everything we possibly can but they keep popping up with new things all the time. We've answered any questions that they've asked the entire job and now with their attorney.

    I am rejecting this response because:

    There is no contractual proof of you willing to take any action. Your strategic deflection and finger pointing is simply a delay tactic and you aren't addressing the issues. Put something in writing of what you are going to do to show actual commitment.

    All you did in the last response was take a document written by the siding company and write a few ok's and excuses...

    1. You have not given any written proposal of your plans to address these things.

    Where is there even a bid or proposal to fix the siding that is now letting water into our basement?

    THERE IS WATER COMING IN OUR HOUSE IN MULTIPLE PLACES ON WORK YOU SAID WAS DONE

    You also tried to be sneaky and tried to downplay the damage to the siding not letting us know when you and **** from ******* ****** came out. It's been two weeks since ******* ****** was out here and there is no bid or document. On 7/17 you falsely claimed he was willing to make the fix before he even came out here to see your poor work - where is proof of his willingness to take the job? I reached out to him when you initially told our lawyer ******* ****** was willing to do the fixes and that was a lie - see emails attached. It wasn't until I went to see **** in person that he came out to my house and gave a bid. Again, I'm doing your job for you.

    2. There is no air circulation in the addition and the contractor you hired said they knew that the work you requested would not suffice.

    Why is there no return vent in the office addition? The room is 4-5 degrees hotter than next room

    3. You didn't provide access to the attic and knowingly cut corner with insulation. 

    As a matter of fact, I DID EMAIL THE INSULATION COMPANY YOU WANT AND THEY NEVER RESPONDED.

    We also had our attorney tell you we demand to speak with them before they do any work but you have refused to make any efforts.

    AGAIN, WHAT IS THE POINT OF YOUR ROLE AS A GENERAL CONTRACTOR IF I'M THE ONE HAVING TO CONTACT ALL OF YOUR SUBCONTRACTORS?

    You also made a claim that your work is WARRANTIED. Where is there any action to address these issues? I should not have even had to file this complaint or get a lawyer in the first place bringing us to this point

    Let's not forget that, in writing, you said all work was complete and demanded payment in full before even having inspections done. 

    I know that your response to this is going to be the same as always just deflecting and not responding to any of the questions I've mentioned above or any proposal

    ONCE AGAIN, PROVIDE A FORMAL PROPOSAL WITH A GLOBAL SOLUTION REGARDING ISSUES ABOVE
