    Myself and my girlfriend **** ****** hired Liberty Contractors 11-26-2023 to build a 22x30 garage. ****** wanted 14,000 dollars down payment which we paid. No work until Feb. paid 20,000 dollars. Two weeks later was told there would be an additional 14,000 dollars due at completion and we talked about making payments for the remaining balance. April footings and brick walls went up. The mason had to redo part of the wall, error on his part. I kept asking ****** when is this going to be done. First response was mid April then mid May then end of May then mid June. He has started framing, **** and I came home from work and we looked at his work, his work was the worst craftsmanship I have ever seen. **** commented I don’t know what I’m looking at but this is not right. Many studs cut to short many nails not contacting the studs and studs not flush. I have Confronted ****** 3 times about him not doing Professional work and if he could not do the job I wanted my money back. As you can imagine he said that’s not gong to happen. On Monday June 10th I sent ****** pictures of all the problems I seen( several pictures). ****** called me and said you need to quit ******* *** picking my work. I replied ****** what in the world are you doing here! This is what 46,0000 dollars worth of work looks like. Workman ship is absolutely terrible. I talked about all the problems with the work and he hastily hung up on me! One of the conversations we had was about the cement work, the driveway and garage floor, all poured the same day, the cement is two weeks old and starting to pit and flake on the surface. I texted ****** the next day and told him the cement work is not good and needs to addressed immediately! ****** has put more walls up and he is piecing everything together! ( studs cut to short and boards being ripped together. I have absolutely no faith in ******** ability to do any type of quality work. I have not heard anything back from the concrete work!

    Liberty Contactors signed an agreement with **** ****** *** ***** ******* on November 26th, 2023, to build a 20’x30’ garage for
    the sum of $34,000.  Work was started December
    7th, 2023, to remove existing paver wall, concrete slab and paver
    planters. Excavation was also started on the project until inclement weather arrived.  The month of January had snow and cold temperatures,
    so work was resumed in February with excavating.  In early February, ***** requested to
    increase the size of the garage to 22’x30’ at an additional cost of $3,500.  There was an additional cost of $8,500 for
    footings and masonry wall due to embankment for a total garage price of $46,000.  **** wrote a check for $14,000 on November 26th,
    2023, and wrote an additional check on April 7th, 2024, for $20,000.  ***** requested a custom garage door on April
    9th for $2,240.00. We are including a written statement from the
    concrete contractor for the garage floor and driveway regarding its
    condition.  The concrete contractor went
    to ***** and *****s house to address each complaint made by ***** no later than
    2 days after the complaint was made. ***** approved the concrete work before the
    final payment was made to the concrete contractor.  Even after the final payment was made to the concrete
    contractor, he still went to ***** and *****s house and addressed *****’s
    complaints on at least 2 occasions.   We
    are including pictures with date stamps to collaborate our work.  All complaints made by ***** were addressed
    properly.  We are including a list of costs
    of the project to date.

    I am rejecting this response because: 

    We want 20,000 dollars refunded instead of 5,000 dollars. There is no rebar in driveway as stated by our contract! 6,000 for cement replacement with rebar and 4,000 for cement removal. ****** did not attempt to do back filling on the block walls. ****** also left 25 tons of dirt in the back yard with no place for drainage! I have trenched a drain way . There is to be leveling, grading and power seeding of grass that was never finished. Water has flooded the house many times because there is drainage and water run off. This amount is 10,000 dollars. For a total refund of 20,000! I feel ****** has taken advantage of **** and myself!

    ***** *** **** were made aware of their existing concrete
    patio slab sloping 2 inches down towards the house in February.  The contractor that poured the footings for
    the garage used a transit level which uncovered the pre-existing problem.  We went to ***** and ****’s house on two
    separate occasions to help them at no charge with their rain gutters.  We found that their gutters we clogged and
    had covers on them causing water to run over the gutters.  Patio will continue to flood when we have
    rain downpours until it is repaired and not sloping towards the house. The
    flooding and existing patio has nothing to do with our scope of work.  We also have pictures of the rain gutter
    downspout that was propped up with a block not allowing it to drain. *****
    contacted us on April 9th concerned with the budget overage due to
    extra charges for footings and 40 additional feet of driveway that was not on
    the original contract while wanting a custom garage door.  The cost savings was approximately $600 that
    ***** wanted to apply to the custom garage door.  ***** put in a verbal change order to not use
    rebar to save on cost.  The contract
    stated rebar in garage floor and roughly 10 feet in front of garage door.  The additional 40 foot of driveway was not
    added until early April to the scope of work. 
    The backfilling was done up to the first stage.  The 2nd stage of backfilling which
    would be the install of drain tile and the final fill was not able to be
    completed because ***** *** **** filed this complaint which caused all work to
    stop as advised by our lawyer.  We’ve
    included pictures showing the backfilling being done up to the first stage.  The only dirt left on property is for the
    final backfill.  We have receipts and
    pictures of all the dirt being removed from the original excavation.  The dirt that was excavated by the footings
    contractor is all that remains for the final backfill.  The driveway contractor assisted with the
    first stage of backfill. Per advice from our attorney, we are now offering a
    refund of $2978 and delivery of custom garage door which is currently being
    stored at our warehouse.  This is our
    final offer.
    *****, **** and ***** all work at the same company.  **** works in the office and has access to
    very vital information which also includes access to insurance, time cards,
    401k, etc.  ***** has had to file a
    formal complaint with the company on ***** for intimidation, harassment and
    concerns with possible retaliation. 
    ***** has spread multiple lies about our company to other employees and
    has created an extremely stressful and hostile work environment.

    I am rejecting this response because: Liberty Contractors LLC just sent 3 photos! I see they are not taking this very seriously!  I have no problem agreeing to pay 6,800 for the Footings and work that ***** * *******e Did! This is the only Quality work that has been done ! There is still the issue with no rebar in the driveway cement! Is this not Fraud? I paid Liberty Contractors LLC for a professional job and was left with a whole lot of problems Liberty Contractors LLC created! I have also talked with Douglas County Attorneys Office and Filled a Police Report against Liberty Contractors LLC and **** ******! Liberty Contractors LLC are the ones that walked of the Job! This is Breach of Contract!

     The last response we gave to ***** was our final decision advised by our lawyer.  We have proven he has lied multiple times with date stamped photos.  I'm not sure I should respond to his last reply because of the retaliation and threats he has done.  I've had to file a formal complaint against him with our employer because of the things he has done.  There is clearly no fraud that took place.  His complaints are a civil matter, not a police matter. This is all because he doesn't have the money to finish the job. We even offered him a payment plan before he filed the complaint against us.  Do I need to respond to his last reply in order to get this closed and resolved?
