    In mid-April of this year, we hired *** **** of DB Painting and Drywall to remove moldy drywall and falling drywall tape, replace it, and paint the vaulted ceiling and all surrounding surfaces as well as the main floor bathroom in our home. His estimate also included painting one wall over the kitchen. At that time, we paid a $3992.00 deposit of the total estimate of $5,926.10, understanding the work would be done in approximately 4-6 weeks. He began the work, removing a section of drywall, and then encouraged us to have a mold abatement company come to inspect before he proceeded, which we did. The company didn't see any extended mold other than what was on the section that had been removed. Despite this reassurance, Mr. **** delayed resumption of the work due to multiple issues, both personal and work related. He promised to come back with his "crew" and "knock it out in a couple of days", but this never materialized. We estimate his time here was a total of 12 hours on his own and twice with another worker, staying for 45 minutes each time, which felt like a ploy to appease us. He did the wallboard removal and repair in the bathroom, but we ended up painting it ourselves because it had to be painted before the fixtures could be reinstalled. In July, we came to a mutual agreement that he could not complete the contract as promised and he would provide us with a partial refund, any remaining materials he'd already purchased, and a receipt for said purchases. Since that time he has, again, had a myriad of excuses for not producing. At this point are asking for a cash refund, minus the 15 hours worked and any (minor) materials used - we don't want the materials he's purchased nor the receipt. He can return them or use them on another job. It's been five months, he's had nearly $4000 of our money. We want it back. In removing trim around the doors to the *****, he damaged wallboard and didn't repair it - we should be compensated for that as well.

    Prior to this complaint submitted I tried contacting the customer for a refund and asked for a mailing address and she failed to give the information for me to send any of the money back. I will refund $2500 back to the customer as agreed. As for the trim being taken down and damaging some drywall I did not remove the trim *** ********** did that so I should not compensate with that as it was not me who damaged that. You are right personal stuff did come up so it prolonged the time frame some but I can not control that my wife had to go to the hospital and then I was sick as well. I was also patient and helped the customer find people for the mold and also had to wait for *** ********** as well so that also prolonged the process. I also suggested a dehumidifier as well because the mold was coming back, so I have been working with the customer with the whole situation. I hope we can settle this and come to an agreement so everyone is happy and taken care of. Our priority is making sure our customers are satisfied.

    I see this complaint is considered resolved - it is not. We have not received any money back from this business. The business owner stated in his response that he "requested a mailing address but never received it". This is a lie. He never asked me for our mailing address and therefore has no way to get the refund to us. Two weeks ago he called and spoke with **** to say that he would be mailing a refund - at that time he didn't ask for an address and we have still not received payment. PLEASE reactivate this complaint and inform the business owner of the correct mailing address (*****************************). We will not consider this complaint resolved until we have received and successfully cashed the refund from this business. Thank you.

    We do not accept the business's response as a resolution to our complaint. We will consider this case resolved when we receive the refund and the check clears. He's been "working on it" for months. If all he needed was an address to send the refund, then what is there to "work on" now that he has the address?

    We have still not received payment from the business owner and it appears he has not replied to our rejection of his reply. Are you able to pass on this message? "If we do not receive payment and supplies purchased (as originally promised) in the next 10 days (by 11/15/24), we will initiate a small claims court claim to recoup our money."
