The total amount due was never discussed. Good morning, ****. First and foremost, I want to take this time to express my concerns/miscommunications. On April 17, 2025, I dropped my bike off for a Service job and checked on an oil leak. You advised me that the Service Job was $500, and I agreed to this service, and you asked me if you wanted me to throw an inspection sticker on the bike as well. I said I was not worried about inspection due to the pipes, and you said no big deal and you would throw a sticker on it. We also agreed this this service. On Saturday, April 26, 2025, around noon, you called me on my cell phone when I was at my camp in ************** and we had a 17-minute telephone conversation about my bike. You explained to me that my service was $500 and the rear brake pads needed replacement. You also talked to me about the cam shaft tensions and explained about the upgraded ones that ****** and mine needed to be replaced. You also said my oil pump needed to be upgraded as well and fully explained all this time to me. After the explanation of all of this, you stated, "To do this job *****, it will cost $1310.00) You also stated that if I were to go to ****** and have them do this job, it would cost me $2300 and that you were saving me a lot of money. I told you that I believed you and that's the reason why I brought my bike to you. I then agreed to fix my bike for $1310.00 as that was within my budget and took your word on saving me the money and trusting your service.Business Response

My response to ***** was this on Friday May 9, 2025. Hi there *****, in response to your last email and going over our written correspondence I think you got the numbers right but out of place. You knew the number $1300 from your April 26th message but that was for parts not a total bill. We have parts and labor. I did say if you went to an HD dealer it would cost you more money and I was trying to get your motorcycle repaired for you as reasonably as possible. The other number that you referred to in that April 26 correspondence was $2300.00 that was my estimated total not what I said that ****** would charge you ( how would I know that number ) ? You also did ask me on April 30 to let you know when the bike was completed and what the total $ would be and you would come up with a game plan to pay your ******* at that time you did not know what the final dollar amount was. The total bill was $1100.00 labor and $1309.00 parts =$2409.99 - $50.00 for sticker ( sorry oversight on my part ) = $2359.99 - $1320.00 received = balance due $1039.99 . Thank you **** LCC So I sent this to ***** and never received a response. Then I received a notice from BBB that he lodged a complaint against my small business. Not only are we looking for retribution of theft of services at this point in the felony range but also going to talk to our ( in house ) attorney about slander and defamation of character ..... ***** trying to badmouth the shop and ruin our brand that we have worked so hard to earn over 30 years. I do not accept the business's response as a resolution to my complaint because:1- I did not intend to steal anything from **** and his small business, matter of fact when he said I needed to keep my bike there until the bill was paid, I told him that he could keep my bike there and called for my ride back to come pick me up. **** then told me that he needed the room, and to take my bike home with me.
2- **** is claiming he is going after me for slander and defamation. This is False. Never once have I slandered or defamed **** and Lee Custom Cycle, nor would I. What I have done is filed a formal legal complaint on **** and his small business, due to a really expensive miscommunication as **** said miscommunications happen
3- I have two witnesses that heard my conversation on the phone with ****, the day he communicated the price with me. One witness is my father, who has been riding motorcycles his whole life and well aware of maintenance costs. When **** quoted me the price, my father even said wow that is a really good deal which was $1,310.00 to do the job and he will testify to this.
4- **** claims that I got the $2300 quote mixed up and it was his actual quote. So **** is clearly admitting that his $2300 quote was still lower than the final bill was. So now we have two different final prices that he is claiming he mentioned to me and not one of them is the final bill. Never once was $1100 in labor mentioned or talked about with me. If **** quoted me $2300 or even the final bill of $2400 plus, i would have denied that service, as Im going through a custody situation in court and didnt have that kind of money on me, so if this was truly talked about, I would of never done this.
5- For **** to be threatening theft of services and slander/defamation, after communicating to me that this could be a miscommunication as it happens and explained to me how it happened to him a few days before, over bags for a bike.
6- **** also charged me for a New Hampshire inspection sticker that I never received and then he mentioned an oversight on his part? I didnt need a New Hampshire inspection of $50 when I live in ***** and registered in ***** and the bike inspection is $13.00 in *****, not $50.
7- Im filing this complaint based on the dishonest and cost that never did I agree to, not the job his business did. I did not slander or defame his business, nor would I. I did not intend to steal anything from ****. **** Claims I did not know the price???? I obviously knew the price as I brought the money that was discussed on the phone call to pay my bill and paid that bill in Cash. $1,320.00

$50 for the inspection sticker, I get sorry my oversight. What else is an oversight? *** never agreed to the service that cost $2409. He claims he gave me an estimated total of $2300, after giving me a price for $1310 to do the job and then a total Bill of $2409 which was never agreed upon, I should not have to be held responsible to pay $2409 that never was talked about, nor agreed to.

Please add. Today, 5-23-25 I was able to get a quote from Rochester ****** ******* for the same service Job that **** quoted me and told me that he would save me money vs going through ******* ******s Quote Today was $1900 for everything. So **** was untruthful and led me to believe he was saving me money over ******* so $1310 doing the project that was agreed to would have saved me money, the $2400 bill that **** gave me would not of saved me money. I will get a copy of the quote through ****** and will attach it for discovery.

I would love to see the alleged quote and see if its apples to apples. As of 1:30 today June 3rd Rochester HD has not given him a quote or an estimate on this repair. We have connections in the motorcycle world that run far and deep. So ***** is not telling the truth about this either. ***** at this point has cheated me out of my labor costs and now has tried to slander my business with more false allegations.
