    I hired this person to replace a sub floor in my mobile home located at ** ****** ****** ********** NH. He went to the property and quoted a price of $800 and I would need to purchase the materials to which I agreed. Before he would schedule he required a 50% deposit. I paid via Venmo on August 24 th and the work was to be done on September 23d. I sent a message earlier in the week confirming the date and requested what time he would arrive. He confirmed the date and stated he’d be there at 10am. He never showed up. I sent a message and he finally replied with a “oh ****”. I then replied and asked if he was still going to be able to do the job. He never replied. I sent multiple messages, called and no response. When he finally did the following day he said he was sorry. At this point I again asked if he was planning to reschedule and again no response. Finally I sent another message request a refund of my deposit. No reply to this message. I again sent a message saying since he was ghosting me he was not going to do the work and that I expected a refund into my acct. To this he said Ok. It has been 2 days and no refund or response to any additional messages

    I have been inpatient at the hospital up until 2 days ago which I can provide documentation to prove that... I tried to resolve and reschedule however the customer refused and I feel that this complaint is unjustified due to a medical emergency which I have documentation to prove... Also customer received full refund through venmo which I can also send verification and proof would love to resolve the issue amicably if that's possible however customer seems adamant to attack my business and myself and not understand that I was in the hospital inpatient.... Dealing with a medical emergency and unable to respond....

    I do not accept the business's response as a resolution to my complaint because: 

    I have attached the original communications between Mr Vertigans and myself about his acceptance of the job.  

    The second attachement is a copy of the messages I received Oct 9th & 10th.   

    I just received notification on the 9th from Bank of America that they were able to collect the money from Venmo for my deposit of $400.

    I take exception to Mr. Vertigans reply to the BBB that I am unwilling to accept his offer to do the work and that I am adament to say negative things about his business. Unless he provided you the documentation validating his stay in a hospital, I have no reason to believe him.   The entire situation is a bit off.   The work has been completed by another reputable contractor so I am not interested in any further ccommunication with Mr. Vertigans and he has mis represented his coorporation in this matter.  

    I do not now how the BBB deals with this situation,  however I do not believe he deserves a positive rating.  As a attorney I am aware of the steps I needed to take to manage this situation, but not everyone does and I would hate for someone else to experience this time or situation with this business.
