Hello, we paid %50 to a material characterization lab to run tests on our patented material. We provided them samples. Only 1 objective out of 6 was completed. They wasted our time for over a year. The CEO lied in person and by email numerous times about when the work would be complete. Yesterday, they delivered us a full invoice by email without any other communication or delivery of test results beside the 1 objective.

Attached are email communications I made to Spica, their invoice, and the email our counsel sent to Spica in response to the invoice that provides a detailed timeline of events. Thank you for assisting. We are a self funded and sweat equity startup and really have no other recourse. I am available to explain or provide saved email evidence if needed.

    Business Response

So complantant sent samples for test with no written instructions, no MSDS data sheets, no purchase order. We wound up contacting FBI and local police not knowing what material was or from whom it came. Lost one day of time for 2 people due to this.

Only a portion of the effort was paid although the complete effort was invoiced. Spica will cancel invoice and refund the complatant his funds.

Please have complantant provide address to send a refund check.

    Regards,

    Michael T*****

    Complaint: ********

I do not accept the business's response as a resolution to my complaint because the attachments will show I have already provided an address with request to return our patent protected material twice. The attachments will also show that I apologized for the delivery situation and gave Michael the opportunity to end the project. Instead he tells me he will proceed. Then proceeds to do nothing except lie about when the work would be completed then invoice me for the full amount of work 7 months later.

I will accept what he "says" he is going to do as a resolution once I receive the refund check. There is no reason for me to believe anything Michael says. The address is ** ********** *** ******* ** *****.

    Sincerely,

    ***** *********
